Motion to Approve Resolution No. 30-26 to award an agreement with Belfor USA Group, inc. for Job Order Contracting utilizing Region 4 Education Service Center (Region 4 ESC) Request For Competitive Sealed Proposal (RFCSP) No. 24-16 four (4) year agreement in the amount of $4,370,950.00; authorizing the City Manager to execute any amendments and/or renewals thereto and take any and all actions necessary to effectuate the intent of this resolution; providing an effective date; and for other purposes.

Background:
The Public Works Department is currently managing a number of Capital Improvement Plan (CIP) projects that can benefit from the expedited project delivery and unit pricing of JOC contract services. These projects include the Delray Beach Municipal Golf Course Clubhouse Renovation (P/N 19-032), Ocean Rescue Locker Room & Storage Improvements (P/N 24-017), and Public Restroom Renovations (for public parks). Additionally, there is a need for contracted mold remediation services for routine facility maintenance by the Building Maintenance Division.
Region 4 ESC has partnered with OMNIA Partners to make the master agreement from solicitation RFCSP No. 24-16 available to other public agencies nationally, including state and local governmental entities, public and private primary, secondary and higher education entities, non-profit entities, and agencies for the public benefit through OMNIA Partners’ cooperative purchasing program. OMNIA Partners is the largest and most experienced purchasing organization for public and private sector procurement. Through the economies of scale created by OMNIA Partners’ public sector subsidiaries and affiliates, participants have access to competitively solicited and publicly awarded cooperative agreements. The City of Delray Beach (City) is currently registered as a Participating Public Agency with OMNIA Partners.
On October 10, 2024, Region 4 ESC issued RFCSP No. 24-16 for Job Order Contracting Services. Job Order Contracting (JOC) Services consist of contracts with contractors for the purpose of performing JOC work order assignments on a recurring basis. JOC services may include minor construction, such as the demolition and/or construction within an existing facility, repair work that involves the repair of a broken system, component, or subcomponent of a building such as doors, electrical outlets, plumbing, flooring, sheetrock, and/or air conditioning systems, etc.; rehabilitation work that involves the restoration of a space, floor, system or component of a system in order to restore functionality; and alteration work that involves changing a structure in terms of layout or function.
Effective March 1, 2025, Region 4 ESC entered into Contract No. R241602 with Belfor USA Group, Inc. (Belfor) pursuant to RFSCP No. 24-16. The initial two-year agreement term is valid through February 28, 2027, with the option to renew for an additional three (3) one-year periods. Any work orders executed against this master agreement during the effective term may survive beyond the expiration of the master agreement as established and agreed to by both parties.

The initial term includes estimated project cost for the CIP projects listed above as well as $60,000 for mold remediation.

The City, at its sole discretion reserves the right to terminate this agreement with or without cause immediately upon providing written notice to the vendor. Upon receipt of such notice, the vendor shall not incur any additional costs under the Agreement. The City shall be liable only for the reasonable costs incurred by the vendor prior to the date of the notice of termination. The City shall be the sole judge of “reasonable costs.”
This motion is in accordance with the Code of Ordinances Chapter 36, Commission Approval Required and Purchasing Policies, Accessing Contracts from Other Government Agencies and Not-for-Profit Organizations.

Timing of Request:
Approval is recommended to begin FY26 CIP projects, especially the clubhouse renovation to align completion with the completion of the golf course construction.
