Move approval for the Final Boundary Plat for Delray Medical Parcel by adopting the findings of fact and law contained in the staff report and finding that the request and approval thereof is consistent with the criteria set forth in Section 2.4.5(K), Minor Subdivision of the Land Development Regulations.

Background:
The item before the City Commission of Delray Beach (Commission) is approval of a final boundary plat (plat) for a 6.376 acre parcel of land to be replatted as Delray Medical Parcel. The subject property is located on the north side of Linton Boulevard, east of Military Trail (4675 Linton Boulevard). The property is zoned PC (Planned Commercial) District.
The purpose of the boundary plat is to subdivide a previously platted parcel into two tracts, Tract 1 containing 3.45 acres and Tract 2 containing 2.918 acres. The proposed plat is a replat of Parcel “A” of the Delray Outpatient Properties Plat, recorded in Plat Book 99, Page 197-201.
On May 20, 2003, the Commission approved the Delray Outpatient Properties Plat, being a replat of Parcel 2 of Delray Town Center (recorded in Plat Book 65, Pages 189-190). The Delray Outpatient Properties Plat, subdivided Parcel 2 of the Delray Town Center Plat into two new parcels, Parcel “A” and Parcel “B”.
Parcel A (the subject property), occupies the western portion of the site and contains an existing two-story, 31,755 square foot medical office/outpatient facility on the northern half of the site.
Parcel B (which is not being replatted and not included in this request) occupies the eastern portion of the site and contains open space and a water management tract that provides retention for the subject parcel and the shopping center to the west.
This plat is not associated with an approved site plan. However, a future two-story 38,245 square foot medical office is proposed on the southern half of the site.
Plat Analysis:
As stated above, the proposed request involves a replat Parcel “A” of the Delray Outpatient Properties Plat to create two tracts, Tract 1 and Tract 2. While no new dedications are included on the plat, it does depict the existing utility easements, ingress/egress easement, drainage easement, and a non-vehicular access easement along a portion of the south property line.
Pursuant to LDR Section 2.4.5(K)(5), no specific findings are necessary for the approval of a final plat for a minor subdivision (or boundary plat) unless it is associated with an approved site and development plan.
City staff has reviewed the plat and determined that all technical comments have been satisfied.
Review By Others:
The plat was processed as a Minor Subdivision therefore, it is forwarded directly to the Commission for final action. No other Board review or action is required.
Courtesy notices have been provided to the following groups and neighborhood associations:

• Sherwood Park Civic Association
To date, no letters of objection or support for the Delray Medical Parcel Plat have been received. Any future letters of support or objection will be presented at the City Commission meeting.
