Recommendation
Motion to Approve Resolution No. 30-24 to award an Agreement with Roadway Construction, LLC. for Construction Services for the Lindell Boulevard Bicycle & Pedestrian Improvements Project, pursuant to ITBC 2023-068 (City Project No. 17-074) in an amount not to exceed $9,957,833.00.
Body
Background:
Following a 2017 application, the City of Delray Beach (City) was awarded a federally funded grant by the Transportation Planning Agency of Palm Beach (TPA) under its Local Initiatives Program for “widening and/or restriping roadways to provide designated bike lanes, construction of pedestrian facilities, shared use paths, greenway/trail corridors, bike and pedestrian lighting and supporting facilities". The program funds on and off-road pedestrian and bicycle facilities; infrastructure for improving non-driver access to public transportation for enhanced mobility; community improvement activities; environmental mitigation; recreational trail projects; safe routes to school projects; and projects for planning, designing, or constructing boulevards and other roadways largely in the right-of-way of former divided highways.
The Lindell Boulevard Improvements Project (City Project No. 17-074) plans to construct sidewalks on both sides of the existing roadway. Currently, there are intermittent sidewalks and no bicycle facilities throughout the corridor. This project will fill in the gaps, as well as add safe, protected bicycle facilities. These improvements will provide an alternative pedestrian and bicycle route to Linton Boulevard and expand bicycle network connections in Delray Beach. All work will be constructed in existing right-of-way and will comply with ADA accessibility requirements.
The project is partially funded through federal funds administered by the FDOT under the TPA Local Agency Program (LAP), as well as local agency funds provided by the City. The State will provide $4,616,235 toward the cost of this project, bringing the total cost to the City to $5,341,598.
On September 21, 2023, the City issued ITBC 2023-068 in order to select a firm which will provide all labor, materials, tools, equipment, supplies, and supervision related to the construction of the Lindell Boulevard Bicycle & Pedestrian Improvements project.
On November 8, 2023, the City received three (3) submittals pursuant to ITBC 2023-068. The bid submitted by Roadway Construction, LLC. was deemed responsive and responsible per the bid requirements.

Approved as to form and legal sufficiency.
Funding Source:
Funding will be available in the Capital Improvement Program (CIP) budget account 334-41-340-541.68-38 to cover current year expenditures following the roll forward of prior year funds. An additional $5,327,487 will be requested in FY24-25 CIP budget. The City will request quarterly reimbursement from FDOT for eligible construction items.
Timing of Request:
Approving this agreement is time sensitive in order to meet FDOT deadlines and the established completion date, which are both important to maintain the construction schedule.
