Approve an Independent Contractor Agreement (Agreement) with Sunflower Landscaping and Maintenance, Inc. (Sunflower) for the provision of Landscape Services for the CRA-owned properties located at 182 & 186 NW 5th Avenue in an amount not to exceed $54,697.50.

Background:
On July 23, 2024, the CRA Board approved a Work Assignment with AGTLAND, P.A. to provide Landscape Architectural Services for the properties located at 182-186 NW 5th Avenue (Subject Properties). Following the completion of landscape enhancement plans, CRA staff obtained three (3) proposals for Landscape Services based on the plans provided.
The landscape enhancement plans call for removal of invasive plant species, sod replacement, tree pruning, installation of landscape bed weed barriers, and installation of new native and non-invasive plants. See Exhibit A for landscape enhancement plans.
Sunflower has provided a proposal for Landscape Services that meets the needs and goals required of the CRA and conforms to the landscape enhancement plans (as confirmed by AGTLAND, P.A.) while maintaining the lowest bid price. See Exhibit C.
The Subject Properties are just off West Atlantic Avenue located along Historic NW 5th Avenue commercial corridor within “The Set”, and within the West Settlers Historic District of the City of Delray Beach. The site consists of two (2) structures on the City of Delray Beach’s Local Historic Register and serve as recognizable anchors at the north end of NW 5th Avenue.
The CRA’s Community Redevelopment Plan (Plan) identifies the NW/SW 5th Avenue corridor within the NW & SW 5th Avenue Beautification Project #2.1 (Project #2.1). The objective of Project #2.1 is to revitalize the NW & SW 5th Avenue corridor into a thriving district for neighborhood businesses and cultural activities with the strategic provision of diverse neighborhood shopping, services, and cultural facilities that will serve to enhance overall business activity and pedestrian activity in the area. The maintenance and enhanacement of the exterior and landscaping at 182 -186 NW 5th Avenue is one way the Delray Beach CRA is ensuring that this objective is realized.
Moreover, Section 163.340(9), Florida Statutes, provides that “[c]ommunity redevelopment” or “redevelopment” means undertakings, activities, or projects of a county, municipality, or community redevelopment agency in a community redevelopment area for the elimination and prevention of the development or spread of slums and blight. Additionally, section 163.370(2)(c)(5), Florida Statutes, provides that the CRA shall have all the powers necessary or convenient to carry out and effectuate community redevelopment and related activities within the community redevelopment area, which may include carrying out plans for a program of voluntary or compulsory repair and rehabilitation of buildings or other improvements in accordance with the community redevelopment plan.
At this time, CRA Staff recommends the approval of the Independent Contractor Agreement, in substantially the same form as attached in Exhibit B, with Sunflower for the provision of Landscape Services for a total Contract Price not to exceed $54,697.50.
