Motion to Approve Resolution No. 164-24 to award an Agreement to M&M Asphalt Maintenance, Inc. DBA All County Paving for Construction Services for the North Swinton Avenue Roadway Underground Utility Improvements project pursuant to ITBC 2024-010 (Public Works Project No. 19-012) in the amount of $8,272,797.51

Body

Background:

The City of Delray Beach’s (City) North Swinton Avenue is experiencing pavement deterioration including uneven surfaces of the roadways, excessive sinkholes, asphalt cracking and accelerated deterioration adversely impacting roadway stability. This has increased maintenance requirements and shortened the lifespan of resurfacing projects. An engineering evaluation of the subsurface stormwater and sanitary sewers has been completed and identified deficiencies requiring correction at this time. The North Swinton Avenue Roadway Underground Utility Improvements Project will address these deficiencies in the existing roadway, underground utility infrastructure, sidewalk continuity and ADA accessibility.

On February 21, 2024, the City issued ITBC 2024-010 in order to select a firm which will provide all labor, materials, tools, equipment, supplies, and supervision related to the construction of the North Swinton Avenue Roadway Underground Utility Improvements project.

On April 05, 2024, the City received one (1) submittal pursuant to ITBC 2024-010. The bid submitted by M&M Asphalt Maintenance, Inc. DBA All County Paving was deemed responsive and responsible per the bid requirements.

On June 27, 2024, the City entered into successful negotiation with M&M Asphalt Maintenance, Inc. DBA All County Paving to reduce some line items prices to be more in line with the engineer’s estimate and other historical/experiential data.

Therefore, staff recommends awarding the construction contract to M&M Asphalt Maintenance, Inc. DBA All County Paving in the base bid price of $ 8,272,797.51.

The first Notice to Proceed (NTP) will be issued for Phase 1 only. The NTP for Phase 2 will only be issued upon substantial completion of Phase 1.

The Agreement terms will be from the date of full execution through the completion of work and full acceptance by the City. The City may terminate this contract without cause and for its convenience by giving seven (7) days prior written notice to the contractor.

This motion is in accordance with Code of Ordinances Section 36.02 Commission Approval Required.
