Motion to Approve a Tri-Party Agreement with the Florida Department of Transportation (FDOT) and the South Florida Regional Transportation Authority (SFTRA) for Surface Crossing Work at 10th Street along the South Florida Rail Corridor (SFRC).

Background:

On July 14, 2023, the Public Works Department was notified by FDOT that a comprehensive analysis of the SFRC mainline was performed to assess the current conditions of the Highway-Rail Grade Crossings throughout Palm Beach, Broward, and Dade counties. All crossings within the three (3) counties were subsequently evaluated and it was determined that the 10th Street Crossing needs to be reconstructed. 10th Street is a City of Delray Beach (City) owned roadway, therefore the City is responsible for costs related to the crossing, such as routine maintenance and rehabilitation projects. SFRTA manages railroad operations on the SFRC on behalf of FDOT and requires an executed agreement to begin design and procurement of materials for the crossing rehabilitation.

 

On October 1, 2024, the City approved the Tri-Party Agreement, then estimated cost to the City $733,613.00 for the surface crossing work to be performed by SFRTA.

 

In 2025, it was determined the agreement should be amended to add reconstruction of the railroad crossing and pedestrian sidewalk installation at the southern crossing point. This request will allow for the complete connection of the new sidewalks on the south side of the crossing recently constructed during the Lowson Boulevard LAP project (Lowson Boulevard/SW 10th Street from Dover Road to US-1/SE 5th Avenue; Grant No. 436896-1-58-01; P/N 2017-009), near SW 15th Ave west to the Fairway Market Plaza (underneath I-95).  This request requires additional surface work in the amount of $191,593.15 (original cost of $733,613.00) for a revised amount of $925,206.15. Crossing traffic control devices (a pedestrian crossing with 2 arms - one on the west and one on the east side of the tracks) are also required for a total of $739,288.70, of which the City is contributing $99,288.70 and FDOT is contributing $640,000.00. The City’s revised total for the work associated with this agreement is $1,024,494.85 ($925,206.15 + $99,288.70).

City Attorney Review:

City Attorney approves as to form and legal sufficiency.

 

Funding Source/Financial Impact:

The funding for the original scope of work ($733,613.00) was approved in the 2025 through 2029 Capital Improvement Plan (CIP) Budget and was encumbered under Purchase Order 2025-947 (Finance Project Code 41070). The funds needed for the amendment to this agreement have been approved in the 2026 through 2030 CIP Budget via 334-41-340-541-63.90 (Finance Project Code 41070).

 

Timing of Request:

Timely approval is requested to begin design services for construction.
