Approve the Interlocal Agreement between the Downtown Development Authority of Delray Beach (DDA) and the Delray Beach Community Redevelopment Agency (CRA) for funding of the Art and Jazz on the Avenue (ILA) in the amount not to exceed $34,000, in substantially the attached form.

Background:
Art and Jazz on the Avenue (the “Event”) started in the late 1980’s with the purpose of bringing people to downtown Delray Beach on East Atlantic Avenue. The Event has evolved, and the location of the event now takes place in different downtown neighborhoods with the goal of bringing locals downtown, promoting downtown businesses, highlighting different neighborhoods, and showcasing the local art community. The Event takes place on October 26, 2022, January 25, 2023, May 24, 2023, and July 27, 2023.
On May 24, 2023, the Event will take place on West Atlantic Avenue from NW 3rd Avenue to NW 6th Avenue. The Event would be a unique opportunity for CRA to disseminate CRA redevelopment information. The CRA has several projects taking place in this area such as the current redevelopment of 98 NW 5th Avenue property, current 95 SW 5th Avenue commercial office building development, the anticipated grand opening of, CRA tenant and grant recipient, Jerk and Lime at Nicole’s House, located on CRA-owned property at 182 NW 5th Avenue, and the CRA also has vacant commercial space at 186 NW 5th Avenue that will be posted for leasing soon. Furthermore, the CRA is conducting a comprehensive study of the CRA-owned properties in the West Atlantic Area and the Event will provide the CRA with the opportunity to survey and obtain feedback from local residents on this matter.
The ILA provides that the CRA will fund the Event on May 24, 2023, in an amount not to exceed Thirty-Four Thousand and 00/100 Dollars ($34,000), to be used by the DDA to pay for City services; sound and lighting; and tents, stage, tables and chairs.
The Delray Beach CRA Redevelopment Plan (“Redevelopment Plan”), Part Two, Section (III)(C), pp. 16-18, identifies various efforts and projects by the CRA to redevelop the West Atlantic Avenue Commercial Corridor.
Additionally, the Redevelopment Plan, Part Three, Section (I)(C), pp. 26-27, identifies several needs of the West Atlantic Avenue Commercial Corridor including a positive image at this entrance to the city center, increasing pedestrian and bicycle activity, improving pedestrian relationship with other uses on West Atlantic Avenue, continuing beautification of West Atlantic Avenue and side streets, etc.
Moreover, the Redevelopment Plan, Part Four, Section (II)(A)(#1.1), pp. 56 - 63, recognizes the West Atlantic Avenue Redevelopment Plan, adopted by the City of Delray Beach in 1995, which encompasses the recommendations from the community stakeholders and project objectives including promoting businesses, developing programs and events and projects which attract new customers to the Avenue, create safer conditions for consumers, residents and businesses, beautifying the West Atlantic Avenue corridor, etc.
Section 163.387(6)(c)(9), Florida Statutes, authorizes the expenditure of CRA funds on “[e]xpenses that are necessary to exercise the powers granted under Section 163.370, as delegated under Section 163.358”. Furthermore, Section 163.370(2)(b) provides that the CRA shall have all the powers necessary or convenient to carry out and effectuate the purposes and provisions to disseminate community redevelopment information.
The funding of the Event will further the goals and objectives of the CRA.
At this time, Staff is recommending the CRA Board approve the Interlocal Agreement between the Downtown Development Authority of Delray Beach and the Delray Beach Community Redevelopment Agency for funding of the Art and Jazz on the Avenue in the amount not to exceed $34,000, in substantially the attached form.

CRA Attorney Review:
The CRA Attorney has prepared the attached Interlocal Agreement between the Downtown Development Authority of Delray Beach and the Delray Beach Community Redevelopment Agency for funding of the Art and Jazz on the Avenue and finds it acceptable as to form.
