Motion to approve the Agreement between the City of Delray Beach and Ric L. Bradshaw, Sheriff of Palm Beach County, Florida, for access to Palm Beach Automated Law Enforcement Management System "PALMS" and/or FCIC to the City of Delray Beach for the administration of criminal justice.

 

Body

Background:

The PBSO Systems User Agreement is a formal agreement between the Palm Beach County Sheriff’s Office (PBSO) and the City of Delray Beach, allowing the Delray Beach Police Department to access the Palm Beach Automated Law Enforcement Management System (PALMS) and Florida Criminal Justice Information Systems (FCIC, NCIC). The agreement outlines the terms of access, including compliance with federal, state, and local regulations, and restrictions on usage strictly for criminal justice purposes. Either party may terminate the agreement with 30 days' notice.

As referenced in the Agreement, the City would also be subject to the terms and conditions of the 2021 Criminal Justice User Agreement executed between the Florida Department of Law Enforcement and the Palm Beach County Sheriff’s Office (attached to this agenda item as back up information). Under the 2021 agreement, user agrees to comply with the disposition reporting provisions and Criminal Justice Information dissemination record keeping requirements of the applicable sections of Florida Statutes, and implementation and adherence to all applicable provisions of the Criminal Justice Information Services Security Policy.
