Motion to approve license agreement program for License Plate Recognition cameras placement on private properties and authorize the City Manager to execute license agreements on behalf of the City.

Background:
The Delray Beach Police Department has been awarded $964,000 through the FY24 COPS Technology and Equipment Program Invitational Solicitation. The funding will be used to add public safety technology throughout the city such as license plate recognition and CCTV cameras. The Special Investigations Section is collaborating with a vendor-approved by both the Delray Beach City Commission and the U.S. Department of Justice-to implement the new technology.
The department has identified key locations across the city for equipment installation. Installations will occur on City property or within public rights-of-way, with appropriate approvals from Palm Beach County or the Florida Department of Transportation as needed.
Additionally, the department is pursuing public-private partnerships to place technology on private property where feasible. These partnerships help reduce costs by providing access to electricity and oftentimes enhance the effectiveness of the technology by offering better placement, particularly for capturing vehicle tags. These partnerships require license agreements for access to private property for equipment placement and to outline City’s responsibility for all installations costs of the equipment. The placement and operation of the equipment would be ongoing and continual until cancelled by either party.
In order to make approval of these license agreements with private entities a streamlined process, the City Commission is asked to approve the license agreement program to allow for license agreements with each private entity to be handled administratively instead of having to be approved individually during Commission meeting. This will provide for a timely execution of license agreements and equipment installation. A sample agreement is attached.
