Background:
Section 2.4.7(E), Appeals, of the Land Development Regulations applies. This is the method of informing the City Commission of the land use actions which may be appealed to the City Commission. After this meeting, the Commission’s appeal opportunity shall expire. An appeal by an aggrieved party must be made within 10 working days of the action. To appeal:
• The item must be raised by a Commission member.
• By motion, an affirmative action must be taken to place the item on the next available meeting of the Commission as an appealed item.
During the specified period, the Site Plan Review and Appearance Board considered the projects noted below. For each item, a project report including the Board Staff Report is attached. No other Boards took action on any appealable applications during this period.
SITE PLAN REVIEW AND APPEARANCE BOARD
ITEM A. 630 George Bush Boulevard
Request: Change of exterior color from grey/beige to (Benjamin Moore) Super White flat.
Board Action: Denied the color change on a 3 to 2 vote (James Chard, Roger Cope and Vlad Dumitrescu voted to deny, Jim Knight absent).
ITEM B. Linton Square, 1425 - 1585 S. Congress Avenue
Request: Amendment to the Blanket Sign Program for the tenant known as Rainbow to allow their corporate colors and to exceed the allowable height.
Board Action: Approved the amendment to the Blanket Sign program on a 5 to 0 vote (Jim Knight absent).
ITEM C. Marketplace of Delray, 14535 S. Military Trail
Request: Amendment to the Master Sign Program for modifications to an existing freestanding sign, directional signage and wall signage.
Board Action: Approved the amendment to the Master sign program on a 5 to 0 vote (Jim Knight absent) with conditions.
ITEM D. Delray Place: Harvest Seasonal Grill & Wine Bar and Local Greens, 1841 S. Federal Highway
Request: Class I Site Plan Modification (architectural elevation changes) for the removal of doors, and the addition of sliding doors, folding windows, and knee walls to open the façade in the area of the outside seating for the building at the NE corner of Eve Street and Federal Highway.
Board Action: Approved the Class I Site Plan Modification on a 6 to 0 vote (Jim Knight absent).
ITEM E. Our Boat House III: 820 SE 5th Avenue
Request: Class I Site Plan Modification for the installation of an awning.
Board Action: Approved the Class I Site Plan Modification on a 5 to 1 vote (James Chard dissenting).
City Attorney Review:
Approved as to form and legal sufficiency.
Timing of Request:
Action must be taken by the City Commission at the next available meeting following the Board’s actions.
