Motion to Approve Resolution No. 110-24 to award an Agreement with Southeastern Engineering for Construction of General Stormwater Infrastructure utilizing City of Fort Lauderdale Invitation To Bid No. 12504-613 in the amount of $3,234,624.

Background:
On March 5, 2021, the City of Fort Lauderdale issued Invitation to Bid (ITB) No. 12504-613 to acquire firms to provide Annual Construction of General Stormwater Infrastructure.
On June 1, 2021, awarded an agreement to Southeastern Engineering Contractors, Inc. pursuant to ITB No. 12504-613. The initial term was for two-years, with two (2) additional one-year renewals.
On March 23, 2023, the first renewal term was executed, extending the contract through May 31, 2024.
On April 15, 2024, the second and final renewal term was executed, extending the contract through May 31, 2025.
The Stormwater Division of the Public Works Department (Stormwater) is responsible for the repair and maintenance of stormwater infrastructure throughout the City of Delray Beach. With approval of this agreement, Stormwater will begin multiple projects, to include, but not limited to, the following Fiscal Year 2024 through 2028 Capital Improvement Program projects:
• Citywide Wastop Check Valve Installation (23-002)
• Drainage Infrastructure Improvements (24-004)
• Artists Alley Drainage Improvements (24-011)
• Lakeview Drive Drainage Improvements (21-003)
The total contract value for the remaining term is $3,234,624.
The City, at its sole discretion reserves the right to terminate this Agreement with or without cause immediately upon providing written notice to Contractor. Upon receipt of such notice, the Contractor shall not incur any additional costs under the Agreement. The City shall be liable only for the reasonable costs incurred by Contractor prior to the date of the notice of termination. The City shall be the sole judge of “reasonable costs.”
This motion is in accordance with Code of Ordinances Section 36.02 Commission Approval Required.
