Motion to Approve Resolution No. 248-25 to award an HBC Engineering Company for Construction Engineering and Inspection Services for the Brant Bridge Lindell Loop Connector Project (Public Works Project No. 20-015) pursuant to RFQ No. 2025-030 in the amount of $552,240.09; authorizing the City Manager to execute any amendments and/or renewals thereto and take any and all actions necessary to effectuate the intent of this resolution; providing an effective date; and for other purposes.

Background:

Following from a 2018 application, the City of Delray Beach (City) was awarded a federally-funded grant by the Transportation Planning Agency of Palm Beach County (TPA) under its Local Initiatives Program for “widening and/or restriping roadways to provide designated bike lanes, construction of pedestrian facilities, shared use paths, greenway/trail corridors bike and pedestrian supporting facilities” for Lindell Boulevard Loop Connection to Brant Bridge (along Blue Jay Turn, Carl Bolter Drive & Avocet Road).

The project is a Complete Streets initiative which will enhance environments for all road users, including motorists, cyclists, and pedestrians.  The project will include shared-use paths and/or sidewalks.  ADA accessibility will be improved with the installation of curbs and ADA ramps.  Milling and resurfacing and pavement markings will be completed along the entire corridor.  Pedestrian scale-lighting will be included where share path is installed along Blue Jay Turn, Carl Bolter Drive & Avocet Road.  Drainage with implementation of exfiltration trenches and swales will be improved along the project as needed. Sanitary sewer lining and rehabilitation will be incorporated along Carl Bolter Drive. All mentioned work will be completed within the existing right of way.

 

On March 7, 2025, the City issued a Request for Qualifications (RFQ) No. 2025-030 to acquire a firm which will provide CEI services related to the construction of this project.

 

On April 9, 2025, the City received four (4) submittals pursuant to the RFQ No. 2025-030.

 

On June 17, 2025, the Selection Committee completed its review of the submittals and made the following rankings.

The Evaluation Committee made a motion on June 17, 2025, at the Initial Technical Evaluation Meeting to hear presentations from the following short-listed firms:

In accordance with Florida Statutes, representatives from the Purchasing and Contract Administration Division and the Public Works Department conducted multiple negotiation meetings with HBC Engineering Company. On September 9, 2025, the first negotiation session was held followed by a second session on September 18, 2025.

 

Staff has reviewed the negotiated fee of $552,240.09 for the Brant Bridge Lindell Loop Connector project and finds it to be fair and reasonable. This fee will be paid based upon the proposed hourly rates and actual hours worked.

 

Construction for the Brant Bridge Lindell Loop Connector project is expected to begin/occur in January 2026. The agreement terms will be from the date of full execution through the completion of work and full acceptance by the City.   

 

Either party, at its sole discretion, reserves the right to terminate the agreement with or without cause immediately upon providing written notice. Upon receipt of such notice, the contractor shall not incur any additional costs under the agreement. The City shall be liable only for reasonable costs incurred by contractor prior to the date of the notice of termination. The City shall be the sole judge of “reasonable costs.”

 

This motion is in accordance with Code of Ordinances Section 36.02 Commission Approval Required.

City Attorney Review:

Approved as to form and legal sufficiency.

 

Funding Source/Financial Impact:

Funding for this project (Finance Project Number 41018) is available in the amount of $2,750,000.00 from 334-41-340-541-68-14 (Capital Outlay FDOT Lindell Blvd Loop) as approved in the Fiscal Year 2026 through 2030 Capital Improvement Program Budget. These funds will be allocated towards CEI and construction services (ITBC No. 2025-052). This project is cash-flow budgeted therefore any additional required funds will be requested in future funding years. The project is also partially funded with federal funds administered by the FDOT under the TPA Local Agency Program (LAP). LAP Grant Agreement No. 441586-1-58-01 will provide $1,671,256.00 toward the cost of this project.

 

Timing of Request:

Approval of this agreement is time sensitive to maintain schedule and grant deadlines.
