Motion to approve Resolution No. 126-24 to award an agreement with Florida ULS Operating LLC DBA Haverland AG Innovations Inc. for baseball field maintenance at Pompey Park pursuant to the Invitation to Bid No. 2024-028 in the amount of $513,371.75 for a total term of five (5) years ($102,674.35 annually); authorizing the City manager to take all actions necessary to effectuate this agreement; and for other purposes.

Background:
On May 1, 2024, the City of Delray Beach (City) advertised an Invitation to Bid (ITB) No. 2024-028 for field maintenance at Pompey Park. Two proposals were received and ULS Operating LLC DBA Haverland AG Innovations, Inc. (Haverland) was the lowest, responsive, and responsible vendor.
The field maintenance will include turf care, weed control, fertilizing, pest control, sand top dressing, and other related maintenance for three (3) acres. Additional work may be required on an as-needed basis and fees are included in the contract value.

The City, at its sole discretion, reserves the right to terminate any contract entered into pursuant to this ITB with or without cause immediately upon providing written notice to the awarded Bidder. Upon receipt of such notice, the awarded Bidder shall not incur any additional costs under the contract. The City shall be liable only for reasonable costs incurred by the awarded Bidder prior to the date of the notice of termination. The City shall be the sole judge of "reasonable costs".
This motion is in accordance with the City Code of Ordinances, Section 36.02 City Commission Approval Required.
