Motion to approve Resolution No. 51-26 to award an agreement with Great Lakes Dredge & Dock Company, LLC pursuant to a Bid Waiver for Beach Renourishment (Sand Placement) Services in the amount of $1,312,700.0; authorizing the City Manager to execute any amendments and/or renewals thereto and take any and all actions necessary to effectuate the intent of this resolution; providing an effective date; and for other purposes.

Background:

The City of Delray Beach (City) has one of the most successful beach maintenance and preservation programs in the United States. Established in 1973, the Delray Beach Shore Protection Program is supplemented by Federal, State, and County funding to renourish and maintain the eroded beach. The program focuses on the protection and enhancement of the beach and coastal resources in accordance with Federal and State permit conditions and consists of the design, permitting, construction and monitoring of approximately 2.6 miles of shoreline.

 

Including the initial construction, a total of nine beach nourishment projects have been constructed to maintain the width of Delray’s beach, including the latest storm protection project in 2020.  The City experienced sand losses during the 2022 hurricane season, primarily associated with Hurricanes Ian and Nicole.  Following the storm season, the City and County requested the United States Army Corps of Engineers (USACE) evaluate and repair damages from the storms.  The USACE found that Delray’s beach was impacted and eligible for a Flood Control and Coastal Emergency (FCCE) Storm Repair project.  This repair project, the Delray Beach Renourishment Shoreline Protection Project (Public Works Project No. 17-081), began in January and will place approximately 450,000 cubic yards of sand on the City’s Beach. To complete the sand fill to the fully permitted template, the City will be placing an additional 750,000 cubic yards to the beach to provide additional storm protection and recreational beach.  The additional advanced fill portion of the project will be cost shared between the State (Florida Department of Environmental Protection - FDEP), Palm Beach County, and the City.

 

To provide increased protection to the erosional hotspots on the southern end, the City applied for permits to add a taper on the southern end of the beach.  This taper, which is outside of the scope of the current USACE project, adds an additional 1,840 linear feet and approximately 103,000 cubic yards of sand to the City’s beach. The City obtained the permits for this work after the release of the bid documents for the original project and was therefore not able to include this scope in the USACE’s bid plans set. 

 

On August 5, 2025, the USACE issued Solicitation No. W912EP25BA015 for the Delray Beach Renourishment Shoreline Protection Project. Pursuant to the solicitation, the USACE awarded Contract No. W912EP25CA012 to Great Lakes Dredge & Dock Company, LLC.

 

Due to insufficient time to conduct an independent solicitation prior to Marine Turtle Nesting Season and to capitalize on the opportunity for reduced mobilization costs, it is in the City’s best interest to engage the USACE contractor for the additional sand placement for the southern taper while they are present performing work for the Delray Beach Renourishment Shoreline Protection Project. 

 

The City, at its sole discretion, reserves the right to terminate this agreement with or without cause immediately upon providing written notice to the contractor.  Upon receipt of such notice, the contractor shall not incur any additional costs under the agreement.  The City shall be liable only for reasonable costs incurred by the contractor prior to the date of the notice of termination.  The City shall be the sole judge of “reasonable costs.” 

 

This motion is in accordance with the Code of Ordinances Section 36.02, Commission Approval Required; and Purchasing Policies and Procedures, Limited or No Competition Acquisitions.

Funding Source/Financial Impact:

This project was approved in the 2025 through 2029 Capital Improvement Plan (CIP) Budget. Funding will become available from 332-363-572.63-90 via budget amendment for unencumbered funds rollover.This project is cost shared amongst the State (50%), the County (20%), and the City (30%).

 

Timing of Request:

Timely approval is requested to continue to ensure the southern taper can be completed while the contractor is on site for the FCCE Storm Repair Project.
