Approve the Interlocal Agreement (ILA) between the City of Delray Beach (City) and Delray Beach Community Redevelopment Agency (CRA) for funding for the Enlargement of Vehicular Storage in the Old School Square Parking Garage - FY 2023-2024.

 

Body

Background:

The City of Delray Beach (City) owns the Old School Square parking garage, located at 95 NE 1st Avenue. A portion of the garage is separated by fencing utilized by the City to store vehicles and golf carts. The CRA approved funding in their FY2023-2024 budget for the installation of additional vinyl-coated chain link fencing to expand the storage area and improve security in the amount of $4,375.00. In exchange, the City will provide access and space in this storage area to the CRA for the storage of vehicles and golf carts. The agreement shall remain in effect for five (5) years with automatic one-year renewals thereafter, unless terminated earlier in accordance with the terms of the agreement.

 

The City or CRA reserve the right to terminate the agreement with or without good cause upon any anniversary of the date of execution of the agreement by providing 30-days written notice to the other. Upon termination of the agreement, the CRA at its sole cost and expense shall remove all of its vehicles, golf carts, and other personal property from the storage area. If the CRA fails to remove any of these items from the storage area, the City may remove at its discretion.
