Approve Resolution 2024-14 and the Agreement with Kauff’s of Palm Beach Inc., to provide vehicle towing and storage services for CRA-owned and/or managed parking facilities through September 17, 2026 (with two (2) options to renew at the CRA’s sole discretion), piggybacking the terms of the CRA’s Agreement with the City of Delray Beach’s towing services agreement, and authorize the Executive Director to execute any related documents.

Background:
Piggyback Agreement:
On February 24, 2023, the City of Delray Beach (City) issued Request for Qualifications No. 2023-007 for a qualified firm to provide vehicle towing and storage services for City-wide needs. Kauff’s of Palm Beach, Inc. (Kauff’s) submitted a proposal in response to the solicitation and was selected by the City after a competitive procurement process, and successfully entered into an agreement with the City on September 18, 2023.
The CRA now has the option to piggyback the terms of the City’s agreement with Kauff’s. The CRA’s Agreement for vehicle towing and storage services for CRA-owned and managed parking facilities with Kauff’s will include the same terms and conditions as stated within the City’s agreement with Kauff’s.
The CRA-owned and managed parking facilities that would be a part of the CRA Agreement:

The initial term of the CRA’s Agreement with Kauff’s shall commence on the date of execution of the Agreement and shall provide vehicle towing and storage services for CRA-owned and managed parking facilities as directed by the CRA through September 17, 2026.
The CRA, at its sole discretion, will have two (2) options to renew for additional one (1) year terms, for an additional (2) years if both options to renew are exercised. If the renewal terms are exercised, the first one (1) year renewal option shall provide vehicle towing and storage services for CRA-owned and managed parking facilities as directed by the CRA commencing on September 18, 2026, through September 17, 2027; the second one (1) year renewal option shall provide vehicle towing and storage services for CRA-owned and managed parking facilities as directed by the CRA commencing on September 18, 2027, through September 17, 2028.
CRA Staff reviewed the City’s solicitation and the City’s agreement with Kauff’s and found it acceptable and in line with the vehicle towing and storage services for CRA-owned and managed parking facilities as required by the CRA. As such, piggybacking the terms of the City’s agreement with Kauff’s not only provides the CRA necessary vehicle towing and storage services, it also provides the CRA with the most efficient means of obtaining said services.
At this time, CRA Staff is requesting the CRA Board approve Resolution 2024-14 approving the CRA’s Agreement for vehicle towing and storage services for CRA-owned and managed properties with Kauff’s of Palm Beach, Inc., with the CRA’s Agreement piggybacking the terms of the City’s agreement and authorizing the Executive Director to execute any related documents.

CRA Attorney Review:
CRA Legal Counsel has drafted the Resolution and CRA’s Agreement and reviewed the City’s Agreement, as to form and determined it to be acceptable.
