Motion to Approve Resolution No. 83-22 to award an Agreement with Kimley-Horn and Associates, Inc. for Professional Engineering Design Services for the Phase II Tropic Isles Roadway Underground Utility Improvements Project pursuant to RFQ No. 2019-040 (Project No. 19-015) in an amount not to exceed $2,925,784.

 

Body

Background:

The City of Delray Beach Public Works Department (City) is responsible for the maintenance of the roadways within the Tropic Isles Development (TID).  Over several years, these roads have experienced uneven surface wear, excessive sinkholes, asphalt cracking, and accelerated deterioration which adversely impacts roadway drainage and driveability.  Furthermore, this deterioration of the roadways caused an increase in maintenance costs and has shortened the lifespan of the roadways.  A recent engineering evaluation of the subsurface soils showed evidence of muck underneath the roadways which is the leading factor in the roadway deterioration.  In addition to the subsurface investigation, a utility assessment was conducted in the TID which determined that both the water and sewer infrastructure is more than 50 years old and reached the end of its useful life expectancy. 

 

Additionally, this area has been identified as a top priority for improvements to the stormwater management system in both the Palm Beach County Local Mitigation Strategy (LMS) prirority list and in the City's Stormwater Master Plan.  As such, this project ranked 11 out of 76 projects in the inaugural year of the Florida Sea Level Rise and Resiliency Program, and was awarded $19.8 million dollars in increments of $6.6 million each year over three years to address these issues.  

 

The Tropic Isles Development is located immediately east of Federal Highway, bordered by Linton Boulevard on the north, the Intracoastal Waterway on the east, and the C-15 Canal on the south. Planned  improvements include raising the elevation and paving of roadways, stormwater management, water main and sanitary sewer replacement, landscaping, and lighting improvements. 

 

The City issued Request for Qualifications (RFQ) No. 2019-040 to acquire a firm to provide professional engineering services related to the Tropic Isles Neighborhood Improvement Project.

 

Phase I of the Agreement produced a Basis of Design Report (BODR) clarifying the detailed Scope of Work for the next phase of the project.  Phase II includes the design and engineering of the project through the bid/award phase, including public outreach.  The City estimates that it will take approximately one year for design/engineering/permitting, and three years for construction to be completed in the neighborhood. 

 

For Fiscal Year 2022, funding is available as follows:

 

            1) Stormwater   -   $338,000

            2) Infrastructure -   $1,803,529

 

The remainder of the funds shall be budgeted and encumbered in Fiscal Year 2023:

 

            1) Water/Sewer -  $   499,694

            2) Stormwater   -   $   284,561

           

 

The Agreement terms will be from the date of full execution thru the completion of work and full acceptance by the City.  Staff has reviewed the estimated project total and finds it to be competitive and reasonable.  

 

This motion is in accordance with Code of Ordinances Section 36.02 Commission Approval Required.

 

City Attorney Review:

Approved as to form and legal sufficiency.

 

Funding Source/Financial Impact:

Funding for this project is available as follows:

377-41-340-541.68-03, Infrastructure Surtax ($1,803,529).

442-36-260-537.68-03, Water and Sewer Renewal and Replacement (This Fiscal Year no funds are requested). For next Fiscal Year, $499,694 will be requested for engineering services.

448-38-300-538.68-03, Stormwater Utility Fund ($338,000).  Additional funds from the account will be requested for next Fiscal Year in the amount of $284,561.

 

Timing of Request:

Approving this agreement is time sensitive in order to meet the established completion date, which is important to maintain the construction schedules.
