Background:

 

Purpose:  To provide fire suppression services and emergency medical services to the Town of Highland Beach (THB) and the City of Delray Beach (DB) in a mutually beneficial manner for both jurisdictions. Services provided to the THB are detailed in Section 3.2 of the agreement. Personnel and equipment detailed for this purpose are detailed in Section 3.7 of the agreement. The DB Fire Chief is responsible for the management and the direction of the personnel, who are DB employees, and equipment per the agreement. There are certain reporting obligations by the DB Fire Department to the THB per the agreement. THB is required to provide and maintain the fire station and any repairs in excess of $ 750.00. The City of Delray Beach is responsible for the telephone, LP gas and routine cleaning of the station.

Term:  Section 5.3 Term of the agreement is October 1, 2016 through September 30, 2025 with the option to renew for 10 year periods upon mutual agreement. Said option must be exercised by THB 18 months prior to expiration date of the agreement. The agreement may be terminated for good cause only in the event of a breach by giving 12 months’ notice. The agreement may be terminated provided 36 month’s by either party.

Financial terms (Sections 4.2-4.5): Requires the THB to pay for the cost of operations for the fire station, personnel expenses and vehicle costs including debt service for the vehicles.  Allows for the invoicing of THB residents for emergency medical transportations subject to a repayment to the THB fees collected for THB residents only.  Provides for the payment of a 5% administrative fee to be paid by the THB to the City of Delray Beach. 

Ownership of Apparatus (Section 5.4): Provides that upon payment of the debt service for the apparatus by the THB that DB will transfer ownership to the THB. Transfer of ownership of the apparatus will occur only to the THB upon payment that eliminates any financial obligation of the City of Delray Beach.
