Motion to approve Resolution No. 177-25 to award a Sole Source Agreement with MWI Corporation for Stormwater Pump Maintenance and Repair Services in the amount of $120,000.00.

Background:
Stormwater pumps are a crucial component of the stormwater system as they convey stormwater produced from tidal and/or rainfall events from neighborhood drainage basins to minimize damaging flooding conditions on roadways and private properties. The City of Delray Beach (City) owns 10 stormwater pumps manufactured by MWI Corporation (MWI) that are maintained by the Stormwater Division of the Public Works Department. These pumps can only be diagnosed and repaired by the manufacturer as the technical specifications are proprietary to MWI.
On July 31, 2025, in accordance with Section 38 of the City’s Purchasing Policies and Procedures Manual, MWI was approved as a Sole Source for the maintenance and repair of these pumps.
The agreement term will commence upon approval by City Commission and shall remain in effect for two (2) years.
Staff estimates that approximately $60,000 will be spent annually on maintenance and related services. Services will be performed by MWI per quotes on an as-needed basis. The cumulative agreement value is provided below:

The City, at its sole discretion, reserves the right to terminate this agreement with or without cause immediately upon providing written notice to the contractor. Upon receipt of such notice, the contractor shall not incur any additional costs under the agreement. The City shall be liable only for reasonable costs incurred by the contractor prior to the date of the notice of termination. The City shall be the sole judge of “reasonable costs.”
This motion is in accordance with City of Delray Beach Code of Ordinances Section 36.02, Commission Approval Required; and Purchasing Policies and Procedures, Section 38, Limited or No Competition Acquisitions.
