Approve the First Amendment to the Interlocal Agreement (ILA) between the City of Delray Beach (City) and Delray Beach Community Redevelopment Agency (CRA) for funding for Capital Improvement Projects within the CRA District for Fiscal Year 2024-2025.

Background:
Implementation of projects, particularly the public infrastructure projects in the CRA District, requires a collaborative effort between the City and the CRA. Through this ILA, the CRA provides funding for all or a portion of projects (i.e., engineering, project management, and construction); while the City provides overall management of the Capital Improvements Program construction and implementation. Projects recommended for funding each fiscal year are included in the City's approved budget through the Capital Improvement Plan (CIP).
The City and CRA enter into an ILA each year to formalize the CRA’s commitment to fund these specific projects. The FY 2024-2025 ILA was adopted by the CRA on November 18, 2024, and the City on January 7, 2025.
The City and CRA desire to enter into the First Amendment of the ILA to amend “Exhibit A” to include funding for two (2) additional projects - Improvements to Crest Theatre and Removal of Roundabout at SW 8th Avenue and SW 2nd Street. It should be noted that the City’s current Fiscal Year 2025 through 2029 Capital Improvement Program (CIP) Budget reflects CRA funding of the Crest Theatre project as the CIP mirrors the City’s funding request submitted for the CRA’s FY 2024-2025 budget. This amendment will address this difference by amending the ILA to include funding for Crest Theatre and amending the City’s CIP budget to include funding for the OSS Campus. Additionally, the First Amendment to the ILA will include funding in both the CRA and City’s budget for the SW 8th Avenue and SW 2nd Street intersection, to include removing the roundabout and intersection improvements.
