Motion to Approve the amendment to Land Development regulations (LDR) Section4.6.5, to permit electrified fences and provide regulation regarding their installation and review, by adopting the findings of fact and law contained in the staff report, and finsing that the text amendment and approval thereof is consistent with the Comprehensive Plan and meets the criteria set forth in LDR Section 2.4.5(M).

Background:
The amendment to the Land Development Regulations (LDR) is privately-initiated and seeks to permit the instllation of "electrified fences" as a part of an alarm system. The proposed amendment includes additional regulations regarding location, electrification, installation, signage, permitting, and emergency shut-off. These types of fences/alarm systems are permitted where outdoor stiorage is approved as an accesory use within the Industrial (I) zoning district, and the Special Activities District (SAD) when outdoor storage is specified in the approving ordinance creating the SAD. The LDRs presently state that no fence may be electrically charged, thereby not permitting any electrified fencing to be installed within the City.
At its meeting of March 21, 2016, the Planning and Zoning Board reccommended approval of the proposed Ordinance, on a vote of 5 to 0 (Joe Pike and Mark Krall absent) subject to the following revisions which have been incorporated into the attached draft Ordinance:
1. That the electrified fence be permitted to be attached to the main perimeter entry gate and be separated by at least 3";
2. That the sign letterng be a maximum of 4" in height ;
3. That the warning signs be permited at a minimum of 30' apart; and,
4. That the warning signs be 1 1/2 square feet.

At the City Commission meeting of May 3, 2016, the Ordinance was approved to Second Reading with the revision to pecify that the electrified fences are permitted when outdoor storage is associated with an industrial use or activity within the I or SAD zoning districts.
