Motion to Approve Resolution No. 46-26 to award an agreement with Royal Auction Group, Inc. for Auctioneer Services utilizing City of Fort Lauderdale RFP Event #21-3; authorizing the City Manager to execute any amendments and/or renewals thereto and take any and all actions necessary to effectuate the intent of this resolution; providing an effective date; and for other purposes.

Background:
The Public Works Department manages the disposal of capital assets, to include totally wrecked vehicles. Pursuant to Section 36.03 of the City of Delray Beach Code of Ordinances, non-real property may be sold or auctioned.
On January 10, 2023, the City of Fort Lauderdale issued RFP Event #21-3 for Auctioneer Services, a revenue generating contract.
Effective June 26, 2023, the City of Fort Lauderdale entered an agreement with Royal Auction Group, Inc. (RAG) pursuant to the RFP. The initial term of the agreement is valid through May 1, 2026, with the option to extend for two (2) additional one-year periods. The City of Fort Lauderdale intends on extending the agreement for another year utilizing one of the two renewal option from May 1, 2026 through April 30, 2027.
Utilizing this agreement, the City may auction non-real property ranging from cars and trucks, heavy equipment, office equipment and furniture, and other equipment and supplies. All items will be sold at public absolute sale to the highest bidder regardless of price without reserve unless a minimum price is established by the City. A combination of online (internet) and public absolute (live) auction services may be used. All items to be auctioned will be transported from the City to RAG’s auction site(s) at no cost to the City. RAG is responsible for removing any vehicle decals and identification specific to the City, especially public safety vehicles. Upon receiving full payment for a titled asset, RAG shall ensure that the vehicle title is transferred into the name of the purchase in the Florida DHSMV system. No titled asset shall leave the auction site while the title is still in the City’s name.
All costs to the City are built into the Buyer’s Premium charged to the purchaser. The fees RAG will collect from purchasers are as follows:
• 10% Buyer's Premium - Public Absolute
• 10-12% Buyer's Premium - On-Line
• Title: $165
• Administration Fee: $25
• 3.5% Credit Card Fee up to $5,000 purchase
RAG shall pay the City the net proceeds from the auction sale within fourteen (14) business days following the auction sale. RAG shall submit a written report to the City listing items sold and gross selling price of the property sold at auction.
The City, at its sole discretion reserves the right to terminate this agreement with or without cause immediately upon providing written notice to the vendor. Upon receipt of such notice, the vendor shall not incur any additional costs under the Agreement. The City shall be liable only for the reasonable costs incurred by the vendor prior to the date of the notice of termination. The City shall be the sole judge of “reasonable costs.”
This motion is in accordance with the Code of Ordinances Chapter 36, Commission Approval Required; and Purchasing Policies and Procedures, Accessing Contracts from Other Government Agencies and Not-for-Profit Organizations, and Revenue Generating Contracts.
