Motion to Approve a General Consulting Services Agreement with R.J. Behar & Company, Inc. for Construction Engineering and Inspection Services (CEI) for the NE 2nd Avenue / Seacrest Boulevard Beautification Project in the amount of $191,567.00. (Project No. 11-067).

Background:
In March of 2015 the City and Florida Department of Transportation (FDOT) entered into a Local Agency Program (LAP) Agreement in the amount of $1,209,570 for the construction phase of the NE 2nd Avenue / Seacrest Boulevard Beautification Project. Federal funds were made available to FDOT by the Federal Highway Administration for Construction Engineering and Inspection ($64,108.00) and construction ($534,232.00). On February 2, 2016, a LAP supplemental agreement providing an additional $100,000 from FDOT for construction was approved by City Commisison. Additional funding was provided by the Community Redevelopment Agency (CRA) in the amount of $1,300,000.00 per the CRA/City Interlocal Agreement with the remaining funding for the project to be provided by the City.
On November 24, 2015, a Request for Qualifications was advertised for CEI Services for the NE 2nd Avenue / Seacrest Boulevard Beautification Project (RFQ No. 2016-022). These services are required by the FDOT for all LAP funded projects. Four firms responded with proposals and a selection committee ranked the proposals on January 28, 2016. The selection committee unanimously agreed that R.J. Behar & Company, Inc. was the top ranked respondent for RFQ No. 2016-022. Calvin, Giordano and Associates, Inc. (CGA) was ranked #2. Amec Foster Wheeler Environment & Infrastructure, Inc. and AE Engineering, Inc. received the same ranking score, thus tied for #3. On March 1, 2016, City Commission authorized City Staff to enter into contract negotiations with the top ranked firm, R.J. Behar & Company, Inc. Negotiations regarding the professional service hours relating to the scope of services were finalized at a Sunshine meeting held on April 18, 2016.
NE 2nd Avenue is considered to be an Off-System roadway, but FDOT requires that the project be constructed using the Big 4 (FDOT) Specifications. This agreement includes full construction administration, testing and sampling, material certifications, final materials acceptance by FDOT, partial contract compliance/EEO, mandatory FDOT Construction and Administrative Compliance Audits, document scanning on LAPIT, and a full Final Estimates Closeout Package.
FDOT budgets 10% to 15% for CEI Services on their FDOT specification projects (which this project is considered to be) and this service authorization is for 10.3% of the overall construction cost.
The recommendation for award complies with the Code of Ordinances, Chapter 36, Section 36.02(C)(3) “Professional Services”.

Timing of Request:
Construction for this project is ready to begin. It is necessary to have the CEI Services provider under contract prior to beginning construction.
