Motion to approve Resolution No. 118-25 to award an Agreement with Delray Intracoastal Cruises, LLC dba Delray Yacht Cruises in accordance with a Bid Waiver for use of the CIty Dock for a term of three years with two-one year renewal options for a total revenue in the amount of $600,000.00.

Background:

Delray Yacht Cruises has operated in Delray Beach for over two decades. Docked at Veterans Park, they offer narrated sightseeing, lunch and dinner cruises, and private charters. They have become an integral part of Delray Beach's vibrant downtown and tourism economy. Their services attract thousands of guests annually and enhance local business activity along the waterfront corridor. In addition to their economic impact, Delray Yacht Cruises has offered free excursions to Delray Beach schools which is not a contractual obligation, but a voluntary contribution. This commitment to community engagement aligns with the City's values and enhances its reputation as a community-focused destination.

 

The Compensation Value is as follows:

 

Initial Term

July 19, 2025-July 18, 2028

 $  360,000.00

 

 

 

Renewal One

July 19, 2028-July 18, 2029

 $  120,000.00

 

 

 

Renewal Two

July 19, 2029-July 18, 2030

 $  120,000.00

 

 

 

 

Total Revenue

 $  600,000.00

 

The City, at its sole discretion, reserves the right to terminate this agreement with or without cause immediately upon providing written notice to the contractor. Upon receipt of such notice, the contractor shall not incur any additIonal costs under the agreement. The City shall be liable only for reasonable costs incurred by the contractor prior to the date of the notice of termination. The City shall be the sole judge of "reasonable costs."

 

This motion is in accordance with the Code of Ordinances Section 36.02, Commission Approval Required; and Purchasing Policies and Procedures, LImited or No Competition Acquisitions.
