(Project No. 17-081), in the amount not-to-exceed $102,489.50.

Background:
The Delray Beach Shore Protection Program consists of the design, permitting, construction and monitoring of approximately 2.6 miles of shoreline. The primary focus of the program is to provide for the protection and enhancement of the beach and coastal resources in accordance with State and Federal permit conditions. The City of Delray Beach holds a Joint Coastal Permit (JCP), Permit No.0303553-001-JC, with the Florida Department of Environmental Protection (FDEP) and the United States Army Corp of Engineers (USACE) for sand nourishment of the beachfront with offshore borrow areas. The JCP has conditions specific to the beach nourishment / construction activities, marine turtle and manatee protection, monitoring, and reporting. The JCP requires annual post-construction physical beach monitoring studies for three (3) years following sand nourishment events. The City of Delray Beach (City) has participated in nine beach nourishment projects from 1973 to 2020, with the most recent sand renourishment project completed in 2020 in response to damages incurred by the 2017 hurricane season. The City is currently in the planning stages for the next regular periodic renourishment event including permitting and construction documents development (engineering), post-construction monitoring for the 2020 (USACE storm repair renourishment) projects.
The Delray Beach Shore Protection Program includes annual topographic (onshore) and bathymetric (offshore) surveys of the beach and offshore. The monitoring data is used to assess, with quantitative measurement, the performance of the beach replenishment projects. The monitoring data provides the City and the Florida Department of Environmental Protection information necessary to plan for the next renourishment project, evaluate the beach performance and optimize the design of the next beach renourishment project.
On August 26, 2015, the City Commission approved an agreement with CB&I Environmental & Infrastructure, Inc. pursuant to Request for Qualifications (RFQ) 2015-01 to provide Coastal Engineering Consulting Services. The Agreement is for assistance with managing the Beach Renourishment Program, including funding applications, permit acquisition, consultant and construction contract supervision, and professional advice and monitoring services regarding the coastline and its management. The Agreement term was for five (5) years from August 26, 2015 through August 25, 2020 with an option to renew for an additional two (2) three-year terms.
On June 30, 2017 CB&I Environmental & Infrastructure, Inc. was acquired by Veritas Capital and has rebranded their business as Aptim Environmental & Infrastructure, Inc. (Aptim). Aptim has expressed its intention to assume all of CB&I Environmental & Infrastructure, Inc. rights and obligations of these awards under the terms and conditions set forth in the Agreement for consulting services with the City. The Consent to assignment from CB&I Environmental & Infrastructure, Inc. to Aptim was approved by the City Commission on March 6, 2018.
On August 13, 2020, the City Commission approved Amendment No.1 to extend the contract period from August 26, 2020 to August 25, 2023.
On August 8, 2023, the City Commission approved Amendment No. 2 to extend the contract through its final renewal period from August 26, 2023, to August 25, 2026.
Under this Service Authorization No. 10, Aptim will provide coastal engineering consulting services including continuing post-construction monitoring for the 2020 storm nourishment project with the annual beach monitoring surveys as well as Blue Flag support for the City of Delray Beach’s Nourishment Program. Total estimated cost for services under Service Authorization No. 10 is in the amount not to exceed $102,489.50.
Pursuant to Sections 161.091 - 161.161, Florida Statutes, the FDEP provides financial assistance to eligible governmental entities for beach erosion control and inlet management activities under the Florida Beach Management Funding Assistance Program. On January 19, 2021, the City Commission approved Grant Agreement 21PB2 with FDEP in the amount of $13,211,945 for their cost share reimbursement of the City’s Shore Protection Project, including surveys of the beach and offshore and construction reimbursements for the next nourishment project, and post-construction monitoring activities from the 2020 storm nourishment project. Grant Agreement 21PB2 was amended in January 2024 to extend the grant expiration to December 31, 2025, in support of the beach program’s next anticipated beach renourishment.
On August 20, 2021, the City Commission approved Grant Agreement 22PB1 with FDEP in the amount of $1,242,499.50 for their cost share reimbursement of the City’s Shore Protection Project including surveys of the beach and offshore and construction reimbursements for the next nourishment project, and post-construction monitoring activities from the 2020 storm nourishment project. Grant Agreement 22PB1 was amended in January 2024 to add $59,300 in support of the beach program and monitoring activities.
The continuing post-construction monitoring for the 2020 storm nourishment project with the annual beach monitoring surveys proposed in Service Authorization No. 10 were programmed in the Fiscal Year 2024 through 2028 Capital Improvement Program Budget.
This motion is in accordance with Code of Ordinances Section 36.02 Commission Approval Required.

Funding Source:
This approval is required for the City to continue planning for the next renourishment event, reporting for the beach nourishment program’s compliance with Federal, State and Local permits and funding assistance for beach renourishment and associated projects. Funding is available from account number 332-41-363-572.34-90 (Beach Restoration Fund-Professional Services/Engineering).
Timing of Request:
This request is time sensitive as the services herein preserve the annually required permit reporting and continues to support the City’s Shore Protection Program.
