RESOLUTION NO. 16-16 - REQUEST FOR ABANDONMENT OF FOUR PUBLIC UTILITY EASEMENTS AND ONE SEWER EASEMENT

Motion to approve Resolution No. 16-16 to abandon a five easements dedicated to the City via Easement Deeds recorded in Official Records Book 1162, Page 568; 1006/262; 1031/195; 23/72; and 8743/1125. of the Public Records of Palm Beach County, Florida, based upon findings that the abandonment requests and approval thereof are consistent with the Comprehensive Plan and meets criteria set forth in Section 2.4.6(N)(5), Abandonment of Public Easements, of the Land Development Regulations.

 

Body

Background:

The easements include four public utility easements and one sewer easement. The easements  contain existing public utilities that will be relocated as part of the Uptown Atlantic redevelopment.  The easements range in size and shape. Two of the easements are located in the 600 block, one of the easements is located on the 700 block, and two of the easements are located on the 800 block.   The easements were dedicated via Official Record Book/Pages 1031/195; 1162/568; 23/72; 8743/1125; and 1006/262.  The legal descriptions and sketch plans are attached.

 

Pursuant to LDR Section 2.4.6(N)(5), the following finding must be made prior the City Commission granting abandonment: The abandonment will not result in the detriment for the provision of utility services to the adjacent properties or the general area.

 

The abandonments will not result in the detriment of services because the utilities will be relocated as part of the redevelopment plan associated with the Uptown Atlantic development. Therefore, the City’s Environmental Services Department and has no objection to the abandonments.

 

City Attorney Review:

Approved as to form and legal sufficiency.

Request is associated with the Uptown Atlantic Mixed-Use development.
