Motion to Approve Amendment No. 3 to Agreement ITBC No. 2025-045 with NMP Golf Construction Corp. for Landscape Services related to the Delray Beach Municipal Golf Course Renovation Project in the amount of $140,000.00 for a revised agreement total of $28,100,667.14.

Background:
On October 14, 2025, the City Commission (City) approved Resolution No. 247-25 to award an agreement to NMP Golf Construction Corp. (NMP) for construction services related to the Delray Beach Municipal Golf Course Renovation Project pursuant to Invitation To Bid Construction (ITBC) No. 2025-045. The total agreement value was $28,560,667.14. The scope of work included full restoration of the 18-hole municipal golf course, which includes new practice facilities, new on-course restrooms, a new maintenance facility, new irrigation system (including pump house), parking lot improvements (including lighting), upgrades to an existing vehicular bridge (for staff and maintenance equipment), and complete replacement of a second existing bridge (for golf carts and maintenance equipment).
Pursuant to Resolution No. 247-25, the City Manager is authorized to execute any amendments and/or renewals and take any and all actions necessary to effectuate the intent of the resolution.
On November 19, 2025, the City Manager approved Amendment No. 1 to the agreement, amending the insurance requirements for Excess Liability Coverage, Pollution Liability Insurance for subcontractors, and additional insurance requirements for subcontractors. This amendment did not result in a change to the monetary value of the agreement.
On July 30, 2026, the City Manager approved Amendment No. 2 to the agreement, reducing the contract allowance for Unforeseen Conditions by $600,000.00 for a revised agreement total of $27,960,667.14. These funds were reallocated towards the purchase of new course maintenance equipment and additional design services.
Staff is requesting approval of Amendment No. 3 to the agreement, increasing Bid-Line L-3 for “New Trees and Palms” by $140,000.00, thereby increasing the total agreement value from $27,960,667.14 to $28,100,667.14. Throughout the course of the project, it was determined that several large trees originally intended to remain on the site needed to be removed due to disease. This increase to the bid-line item will support the replacement of these trees and any other landscape changes as necessary.
This motion is in accordance with Code of Ordinances Section 36.02, Commission Approval Required; and Purchasing Policies and Procedures Section 48, Change Orders and Amendments.

Funding Source:
Funding for this project (Finance Project Number 75012) was approved at the October 13 City Commission meeting via budget amendment. This amendment and the related scope of services will be funded by the Tree Trust Fund. Pursuant to Appendix A, “Definitions”, of the Land Development Regulations of the City of Delray Beach, the Tree Trust Fund is “an account into which in-lieu fees for the planting or replacement of trees or palms are deposited to off-set the City's costs for future trees and palms, tree trimming, and tree maintenance. No more than ten percent of the annual balance may be used for tree trimming and maintenance.” Funding is available from GL account 115-41-000-572.34-90.
Timing of Request:
Timely approval is requested to avoid delays in project completion.
