Motion to Approve Resolution No. 30-25 to award an Agreement to MBR Construction, Inc. for the Replacement of Beach Master Plan Showers & Fountains project (pursuant to ITBC No. 2024-037 (Public Works Project No. 24-009) and Beach Access Improvements pursuant to ITBC 2024-038 (Public Works Project No. 24-008) in the amount of $530,000.00.

Background:
On September 20, 2016, the City of Delray Beach (City) approved the City Standard and purchase of beach showers and fountains for the Beach Master Plan. The stainless-steel showers and fountains were designed and specified in the Beach Master Plan by the City’s architect for the project. Although the particular style and brand of showers and fountains meet the City’s requirements for performance, consistency, and compatibility in the beachfront environment, many of the showers and fountains are due for replacement. To continue to provide functional beach amenities, a necessary component of the Beach Master Plan and the Blue Flag Beach designation, the Public Works Department has planned for improvements along the beach promenade, to include replacement of the showers and fountains.
The Replacement of Beach Master Plan Showers & Fountains project includes the removal and installation of thirty (30) showers and six (6) drinking water fountains.
The Beach Access Improvements project includes the installation of precast concrete benches at seventeen (17) beach access points, five (5) north of Atlantic Avenue and twelve (12) south of Atlantic Avenue, along a 1.3-mile section of A1A. The purpose of the installation of the pre-cast concrete benches is to minimize the transfer of beach sand from the dune and into the stormwater drains that serve the shower facilities installed as part of the Beach Master Plan.
On July 31, 24 and August 29, 2024, the City issued ITBC No. 2024-037 and ITBC No. 2024-038, in order to select a firm which will provide all labor, materials, tools, equipment, supplies, and supervision related to the construction of the Replacement of Beach Master Plan Showers & Fountains project and Beach Access Improvements project, respectively.
On August 28, 2024, and October 2, 2024, the City received submittals pursuant to ITBC No. 2024-037 and ITBC No. 2024-038. The bids submitted by MBR Construction, Inc., for both solicitations, were deemed responsive and responsible per the bid requirements.
In an effort to reduce costs associated with executing these projects independently (such as general conditions, and Maintenance of Traffic costs), staff from the Contracts and Administration and Public Works Department began negotiations with MBR Construction, Inc. to consider consolidating the projects into a combined agreement. This would also allow the contractor to work on both projects concurrently. The original bid price for Replacement of Beach Master Plan Showers & Fountains was $331,613.75. The original bid price for Beach Access Improvements was $259,579.00. The result of combined agreement for $530,000.00 resulted in a $61,193 savings to the City, therefore, staff recommends awarding the construction contract to MBR Construction, Inc.
This motion is in accordance with City of Delray Beach Code of Ordinances Section 36.02, Commission Approval Required.
