Motion to Approve and Execute consent to easement agreements to construct, repair, and maintain, two seawalls within a federal real estate easement for the Seawall Replacement and Repair Project (Public Works Project No. 24-001).

 

Body

Background:

 

The City of Delray Beach (City) is planning to replace and/or repair various City owned and maintained seawalls throughout the City. These seawalls have been identified in the City of Delray Beach Publicly Owned Seawalls Assessment Report dated July 24th, 2023 (APTIM), which evaluated the existing seawall condition and vulnerability related to projected increases in sea level. The 2023 assessment identified and prioritized seawalls in need of full replacement and/or repair.

 

On February 21, 2026, the City issued ITBC No. 2026-021 in order to select a Contractor for the replacement and/or repair of the various seawalls. The scope of the project includes the full or partial replacement of eleven (11) seawalls and the repair or enhancement of five (5) seawalls. The project will also bring the City-owned seawalls into compliance with the seawall ordinance, which requires both public and private seawalls at minimum elevation +4.2 NAVD88.

 

On June 2, 2026, the City Commission approved Resolution No. 87-26 to award an agreement to YC Group, LLC for construction services related to the Seawall Replacement and Repair Project.

 

Given the proximity of the various seawall locations along the Intracoastal Waterway, the City was required to submit for permits with the United States Army Corps of Engineers (USACE). The USACE requested that the City execute Consents to Easement (CTE) for two (2) seawalls, located at SE 7th Street and at Mangrove Park.

 

This item is for the approval and execution of the CTEs, to fulfill the USACE permit requirements and to facilitate the construction of the proposed seawall improvements.

Funding Source:

There is no cost impact associated with these easements; however, funding for this project (Finance Project Number 41055) is available from GL account 448-38-300-538-63.90.

 

Timing of Request:

These easements are high priority as they should be in place prior to the construction of the new seawalls.
