Motion to Approve Resolution No. 139-24 to award an Agreement with Mock, Roos & Associates, Inc. for Construction Engineering, and Inspection Services for the Thomas Street Stormwater Pump Station Replacement project (Public Works Project No. 18-017) pursuant to RFQ No. 2023-048, in the amount of $1,398,082.00.

 

Body

Background:

The City of Delray Beach (City) owns and operates the Thomas Street Stormwater Pump Station located at the westernmost end of the Thomas Street City-owned right-of-way (adjacent to the Intracoastal Waterway) in Delray Beach, Florida. This pump station currently provides stormwater pumping for the 50-acre drainage basin including Thomas Street, Vista Del Mar Drive, and part of Andrews Avenue and Lowry Street. The City of Delray Beach Stormwater Master Plan, completed by ADA Engineering in February 2019, proposed capacity increases and other major infrastructure improvements to meet South Florida Water Management District and Level of Service criteria for both current and 30-year Sea Level Rise tidal conditions.

 

The Thomas Street Pump Station is a vital lifeline for approximately 800 residents living in the 50-acre drainage basin. The original pump station was built in the 1970’s and has reached the end of its designed useful life (about 50-years). The original pump capacity was designed for a 25-year, 3-day storm event at the time it was designed, which is 18,000 gallons per minute (GPM).  In addition, higher pump capacity is required to meet South Florida Water Management District’s (SFWMD) Level of Service (LOS) criteria for both current and 30-year Sea Level Rise (SLR) and tidal conditions. The existing pump station has no backup generator, and its sole power source comes from overhead powerlines, which can render the pump station out of service during frequent outages in peak hurricane season. Finally, the existing pump station does not provide any water quality improvement to the stormwater prior to discharge to the Intracoastal Waterway.

 

A new 85,000 GPM stormwater pump station will be constructed with an upgraded drainage network, backup generator, diesel fuel tank, buried underground powerlines and onsite water treatment facility. The Public Works Department will be responsible for operating and maintaining the proposed project.

 

On August 1, 2023, the City issued RFQ No. 2023-048 to acquire a firm which will provide Construction Engineering, and Inspection (CEI) Services related to the construction of this project. 

 

On September 13, 2023, the City received two (2) submittals in response to the RFQ, including proposals from Mock Ross & Associates, Inc. and Metric Engineering Inc.

 

On January 22, 2024, the Selection Committee completed its review of the submittals and made the following recommendations:

In accordance with Florida Statutes, representatives from the Purchasing and Contract Administration Division and the Public Works Department conducted multiple negotiation meetings with Mock, Roos & Associates, Inc. On February 21, 2024, the 1st Negotiation session took place, followed by a 2nd Negotiation session on April 9, 2024, followed by a 3rd Negotiation session on May 1, 2024, and a 4th Negotiation session on May 28, 2024, to finalize the terms of the Agreement.

 

Staff has reviewed the negotiated fee of $1,398,082.00 and finds it to be fair and reasonable.  This fee will be paid based upon the terms of the negotiated agreement.

 

The project is expected to be completed by September 2026. The Agreement terms will be from the date of full execution through the completion of work and full acceptance by the City.

 

The City, at its sole discretion, reserves the right to terminate any contract entered into pursuant to this RFQ with or without cause immediately upon providing written notice to the selected proposers.

 

This motion is in accordance with Code of Ordinances Section 36.02 Commission Approval Required.

Funding Source:

Funding for this project (Finance Project Code 41031) is available in account 448-38-300-538-68-04 (Capital Outlay Thomas Street Station). The project is partially funded by the Florida Department of Environmental Protection (FDEP) under the Resilient Florida Program in the amount of $2,500,000 (Grant Agreement No. 22FRP134) and by FDEP under the Water and Springs Restoration Program in the amount of $1,837,500 (Grant Agreement No. LPA0277). The combined supplemental funding amounts to $4,337,500.

 

Timing of Request:

Timely approval of this agreement is requested. The Invitation to Bid Construction (ITBC) for this project is scheduled for solicitation in late June or early July 2024.
