Motion to Approve Resolution No. 55-24 to award an Agreement to Rosso Site Development, Inc for Construction Services for the Barwick Road Bicycle and Pedestrian Improvements Project pursuant to ITBC 2024-009 (Public Works Project No. 17-072) in the amount of $7,764,375.44.

Background:
Following a 2017 application, the City of Delray Beach (City) was awarded a federally funded grant by the Transportation Planning Agency of Palm Beach (TPA) under its Local Initiatives Program for “widening and/or restriping roadways to provide designated bike lanes, construction of pedestrian facilities, shared use paths, greenway/trail corridors, bike and pedestrian lighting and supporting facilities". The program funds on and off-road pedestrian and bicycle facilities; infrastructure for improving non-driver access to public transportation for enhanced mobility; community improvement activities; environmental mitigation; recreational trail projects; safe routes to school projects; and projects for planning, designing, or constructing boulevards and other roadways largely in the right-of-way of former divided highways.
The Barwick Road Bicycle and Pedestrian Improvements project plans to construct sidewalks on the west side along with a shared use path on the east side between Atlantic Avenue and Lake Ida Road. Currently, there are intermittent sidewalks throughout the corridor. Crosswalks and ramps will be improved to facilitate drivers yielding at conflict points. These improvements will directly benefit Carver Middle School and expand bicycle network connections in Delray Beach. All work will be constructed in existing right-of-way and will comply with ADA accessibility requirements.
The project is partially funded through federal funds administered by the FDOT under the TPA Local Agency Program (LAP), as well as local agency funds provided by the City. The State will provide $3,927,561 toward the cost of this project, bringing the total cost to the City to $3,836,814.44.
On October 27, 2023, the City issued ITBC 2024-009 in order to select a firm which will provide all labor, materials, tools, equipment, supplies, and supervision related to the construction of the Barwick Road Bicycle & Pedestrian Improvements project.
On December 13, 2023, the City received three (3) submittals pursuant to ITBC 2023-068. The bid submitted by Rosso Site Development, Inc was deemed responsive and responsible per the bid requirements.

Therefore, staff recommends awarding the construction contract to Rosso Site Development, Inc in the base bid price of $7,764,375.44.
This motion is in accordance with Code of Ordinances Section 36.02 Commission Approval Required.

Approved as to form and legal sufficiency.
Funding Source:
Funding for this project is available in the account 334-41-340-541-68.08 (Capital Outlay FDOT Barwick Rd Compl Street) in the amount of $3,238,955. These funds will be allocated to between CEI and construction services. This project is cash flow budgeted therefore additional funds will be requested in future fiscal years through the Capital Improvement Program (CIP) budget. The City will request quarterly reimbursement from FDOT for eligible construction items.
Timing of Request:
Approving this agreement is time sensitive in order to meet FDOT deadlines and the established completion date, which are both important to maintain the construction schedule.
