Approve Resolution No. 2026-12, a First Amendment to the Purchase and Sale Agreement for one (1) CRA-owned vacant lot located at 238 SW 14th Avenue for the development of one (1) affordable/workforce single-family home between the Delray Beach Community Redevelopment Agency and Boynton Beach Faith Based Community Development Corporation, Inc., to extend the completion date by 292 calendar days to October 31, 2027, for the construction of and issuance of the certificate of occupancy for one (1) single-family home.

Background:
On July 16, 2025, the Delray Beach Community Redevelopment Agency (CRA) and Boynton Beach Faith Based Community Development Corporation, Inc., (Boynton CDC) entered into a Purchase and Sale Agreement (PSA) for one (1) CRA-owned vacant lot located at 238 SW 14th Avenue (Subject Property) for the development of one (1) affordable/workforce single-family home. The PSA currently states that the Completion Date for the construction of and issuance of the certificate of occupancy for the one (1) single-family home is January 12, 2027.
Boynton CDC initially submitted a building permit application to the City of Delray Beach (City) for the Subject Property in October 2025. The building permit was subsequently approved in February 2026. The delay in starting construction of the single-family home was related to a fence encroachment issue summarized below.
Fence Encroachment:
The Subject Property abuts a single-family residential property to the south which has an existing fence that encroaches onto the Subject Property. Surveys were obtained to confirm the fence encroachment and CRA Staff worked with the abutting property owner to come to an agreement to relocate the fence to follow the property boundaries. CRA Staff is currently coordinating with the abutting property owner to assist in obtaining the fence permit and to facilitate the relocation and installation of the new fence. On September 9, 2026, Boynton CDC requested a 292-calendar-day extension to the Completion Date due to delays related to resolving the fence encroachment. The revised Completion Date would be October 31, 2027. Correspondence from Boynton CDC requesting the extension is included as Exhibit D.
At this time, CRA Staff recommends the approval of the First Amendment to the Purchase and Sale Agreement between the Delray Beach Community Redevelopment Agency and Boynton Beach Faith Based Community Development Corporation Incorporation, Inc., to extend the Completion Date by 292 calendar days to October 31, 2027, for the construction of and issuance of the certificate of occupancy for one (1) affordable/workforce single-family located at 238 SW 14th Avenue.

The CRA Legal Counsel has prepared and reviewed the First Amendment to the Purchase and Sale Agreement for legal sufficiency and form and determined it to be acceptable.
