Approve the Work Assignment for Landscape Architect Services with AGTLAND, P.A., for the property located at 135 NW 5th Avenue.

Background:
On May 30, 2024, the CRA Board approved a Continuing Consulting Services Agreement with AGTLAND, P.A. to provide Landscape Architectural Services.
Following the approval of the Agreement, CRA staff reached out to AGTLAND, P.A. to provide a proposal for Landscape Architectural Services for the Subject Property located at 135 NW 5th Avenue - just off West Atlantic Avenue located along Historic NW 5th Avenue commercial corridor within “The Set”, and within the West Settlers Historic District of the City of Delray Beach. The Subject Property is a mixed-use two-story building comprised of two (2) CRA-owned first-floor commercial units and four (4) privately owned residential condominiums. The CRA-owned first-floor commercial units front NW 5th Avenue where the exterior landscaping improvements will be placed.
The CRA’s Community Redevelopment Plan (Plan) identifies the NW/SW 5th Avenue corridor within the NW & SW 5th Avenue Beautification Project #2.1 (Project #2.1). The objective of Project #2.1 is to revitalize the NW & SW 5th Avenue corridor into a thriving district for neighborhood businesses and cultural activities with the strategic provision of diverse neighborhood shopping, services, and cultural facilities that will serve to enhance overall business activity and pedestrian activity in the area. The development and maintenance of affordable commercial, retail, and professional office space in the Northwest Neighborhood at 135 NW 5th Ave. is one way the Delray Beach CRA is ensuring that this objective is realized.
Moreover, Section 163.340(9), Florida Statutes, provides that “[c]ommunity redevelopment” or “redevelopment” means undertakings, activities, or projects of a county, municipality, or community redevelopment agency in a community redevelopment area for the elimination and prevention of the development or spread of slums and blight. Additionally, section 163.370(2)(c)(5), Florida Statutes, provides that the CRA shall have all the powers necessary or convenient to carry out and effectuate community redevelopment and related activities within the community redevelopment area, which may include carrying out plans for a program of voluntary or compulsory repair and rehabilitation of buildings or other improvements in accordance with the community redevelopment plan.
At this time, the Subject Property is in need of exterior landscape improvements. Through the improvement of the exterior of the Subject Property, the CRA is carrying out the goals laid out in the CRA’s Redevelopment Plan and as empowered by Florida Statutes.
The Scope of Services for the Project includes full Landscape Architectural Services, which will include plans (which will remove invasive species that are currently planted at the Subject Property and include the use of native Florida plants and sustainable landscape elements) ready for permitting and bidding. The cost to fulfill the Scope of Services will not exceed $4,000. See Exhibit D.
At this time, CRA staff is seeking approval of the Work Assignment with AGTLAND P.A. to complete site inventory and analysis, design development and plant selection, completion of landscape plans ready for permitting, bid assistance, and construction administration, and authorize the CRA Board Chair to execute all documents related to the Work Assignment.

CRA Attorney Review:
The CRA Legal Advisor has drafted and reviewed the Work Assignment for legal sufficiency and form and determined it to be acceptable.
Funding Source/Financial Impact:
Funding is available in the amount of $4,000 - GL# - Project Development/Implementation and GL# 8409 - Contractual Services
