Approve the Interlocal Agreement between the City of Delray Beach and Delray Beach Community Redevelopment Agency to fund a portion of the City of Delray Beach Disparity Study in an amount not to exceed $50,000.

Background:

 

At the May 14, 2019, Delray Beach Community Redevelopment Agency (CRA) Workshop, and the May 14, 2019, CRA Board Meeting, there were discussions related to the “Keep it Local” policies and initiatives that are currently in place at the City of Delray Beach (City) to promote local businesses and job opportunities.  Additionally, discussions related to a Disparity Study also occurred. The purpose of conducting such a study would be to determine whether or not a statistically significant disparity exists within the City’s award of contracts to minority and woman owned enterprises.  At the May 14, 2019, CRA Board Meeting, the CRA Board unanimously approved its support of the City in moving forward with its “Keep it Local” policies and conducting a disparity study.

 

At the December 10, 2019, the CRA Board support the CRA to providing twenty percent (20%) of the required funding for the City to conduct a disparity study. 

 

Pursuant to the CRA Board’s support, the CRA and the City have engaged in multiple discussions regarding the funding of a disparity study. In January 17, 2023, the City is engaged the services of Keen Independent Research, LLC, (Consultant) to conduct a disparity study (Study) with a contract amount of Two Hundred Forty Two Thousand Three Hundred Fifty Six Dollars and 00/100 Cents ($242,356.00).

 

Section 163.370(5), Florida Statutes states “[a] community redevelopment agency shall procure all commodities and services under the same purchasing processes and requirements that apply to the county or municipality that created the agency.  Therefore, considering that the CRA utilizes the City purchasing policy and the CRA provides funding to the City for various projects, the CRA contracts should be reviewed as part of the Study.  The Consultant is determining the cost to review the CRA contracts and the City will amend their agreement with the Consultant accordingly.

 

 

 

 

The CRA remains steadfast for growing a more resilient local economy through initiatives and efforts that promote local sourcing and will follow the lead of the City with any new efforts to create formal programs or policies which establish more participation of minority, women, small, or local business enterprises in future procurement opportunities.

 

At this time, CRA Staff is bringing this item up for discussion and direction. As the Disparity Study would be a citywide initiative, CRA Staff is requesting the CRA Board’s support for the CRA to provide twenty percent (20%) of the required funding for the City to conduct the Disparity Study.

 

At such time CRA Staff is seeking approval of the Interlocal Agreement between the City and the CRA to fund a portion of the disparity study in an amount not to exceed $50,000.
