Motion to approve Resolution No. 05-26 to award an Agreement with Motion Industries, Inc. dba Hydraulic Supply Co. for Hydraulic Hoses and Repairs for Heavy Duty Trucks and Equipment utilizing the City of Boca Raton ITB No. 2022-054 in the amount of $40,000.00

Background:
The Fleet Maintenance Division (Fleet Maintenance) of Public Works has an on-going need to ensure prompt repairs for heavy duty trucks and equipment can be facilitated.
On August 1, 2022, the City of Boca Raton publicly advertised ITB No. 2022-054 for Hydraulic Hoses and Repairs for Heavy Duty Trucks & Equipment. On September 30, 2022, a Notice of Award was issued to Motion Industries, Inc. dba Hydraulic Supply Co. (Hydraulic Supply) pursuant to ITB No. 2022-054. The initial agreement period was for one-year, effective October 1, 2022, through September 30, 2023. The agreement allows for four (4) one-year renewal periods, leaving approximately two (2) terms (2025-2026, 2026-2027) remaining.
To continue to ensure prompt and reliable repairs to City-owned heavy duty trucks and equipment, Fleet Maintenance is requesting approval of the agreement with Motion Industries.

The City, at its sole discretion, reserves the right to terminate this agreement with or without cause immediately upon providing written notice to the contractor. Upon receipt of such notice, the contractor shall not incur any additional costs under the agreement. The City shall be liable only for reasonable costs incurred by the contractor prior to the date of the notice of termination. The City shall be the sole judge of “reasonable costs.”
This motion is in accordance with the Code of Ordinances Chapter 36.02, Commission Approval Required; and Purchasing Policies and Procedures, Accessing Contracts from Other Government Agencies and Not-for-Profit Organizations.
