Motion to approve of Resolution No. 59-25 to award an agreement Dobbs Equipment, LLC, as an approved Sole Source, for the purchase of John Deere Construction & Forestry Company OEM Parts and Repair Services in the amount of $60,000.

Background:
The Fleet Division (Fleet) of the Public Works Department has a responsibility to maintain the City of Delray Beach’s (City) construction equipment, such as combination backhoes, skid steer, wheel loaders and excavators, manufactured by John Deere Construction & Forestry Company (John Deere). Parts and repair services for John Deere construction equipment are considered proprietary. Dobbs Equipment, LLC (Dobbs), is the only authorized John Deere construction equipment dealer representative servicing South Florida that employs equipment repair and maintenance technicians that are factory trained and certified on John Deere equipment. Dobbs has been designated a Sole Source for OEM parts and services for John Deere construction equipment for the City of Delray Beach since 2018.
The agreement shall remain in effect for a term of two (2) years, as long as the vendor remains a Sole Source. The total agreement value is $60,000.
The City, at its sole discretion, reserves the right to terminate this agreement with or without cause immediately upon providing written notice to the vendor. Upon receipt of such notice, the vendor shall not incur any additional costs under the agreement. The City shall be liable only for reasonable costs incurred by the vendor prior to the date of the notice of termination. The City shall be the sole judge of “reasonable costs.”
This motion is in accordance with City of Delray Beach Code of Ordinances Section 36.02, Commission Approval Required; and Purchasing Policies and Procedures, Limited or No Competition Acquisitions.
