Background:
Section 2.4.7(E), Appeals, of the Land Development Regulations applies. This is the method of informing the City Commission of the land use actions which may be appealed to the City Commission. After this meeting, the Commission’s appeal opportunity shall expire. An appeal by an aggrieved party must be made within 10 working days of the action. To appeal:
• The item must be raised by a Commission member.
• By motion, an affirmative action must be taken to place the item on the next available meeting of the Commission as an appealed item.
During the specified period, the Historic Preservation Board and the Site Plan Review and Appearance Board considered the projects noted below. For each item, a project report including the Board Staff Report is attached. No other Boards took action on any appealable applications during this period.
HISTORIC PRESERVATION BOARD
ITEM A. 106 SE 7th Avenue, Marina Historic District
Request: Class II Site Plan Modification, Architectural Plan and Certificate of Appropriateness for additions and alterations to a contributing structure and accessory garage.
Board Action: Approved the Class II Site Plan Modification, Architectural Plan and Certificate of Appropriateness on a 7 to 0 vote.
SITE PLAN REVIEW AND APPEARANCE BOARD
ITEM B. Seagate Towers, 200-220 MacFarlane Drive
Request: Change of exterior color from Abingdon Putty, Lancaster Whitewash, and Louisburg Green (Benjamin Moore) to Puritan Gray and Dune White (Benjamin Moore).
Board Action: Approved the color change on a 6 to 0 vote.
ITEM C. Weekes & Callaway, 3945 West Atlantic Avenue
Request: Class III Site Plan Modification, Landscape Plan and Architectural Elevations request for the construction of a 3,501 sq. ft. building addition with associated parking lot upgrades and landscaping improvements
Board Action: Approved the Class III Site Plan Modification, Landscape Plan and Architectural Elevation Plan on a 5 to 0 vote (Andrew Youngross stepped down) with conditions.
ITEM D. 405 North, 405 SE 6th Avenue
Request: Class V Site Plan, Landscape Plan, Architectural Elevations, and Waiver requests for the demolition of an existing one-story office building and construction of a new two-story office building with associated parking.
Board Action: Denied the Class V Site Plan and Landscape Plan on a 6 to 0 vote. The Architectural Elevations were approved on a 5 to 1 vote (Andrew Youngross dissenting). The waiver requests to reduce the terminal landscape island from 9’ to 2’ was denied on a 3 to 3 vote (Roger Cope, Andrew Youngross and Jose Aguila dissenting), and the waiver request to reduce the perimeter landscape buffer was denied on a 5 to 1 vote (Vlad Dumitrescu, Roger Cope, Jim Knight, Andrew Youngross and Jose Aguila dissenting).
(The applicant has appealed the actions of the SPRAB and this is scheduled for City Commission consideration on the July 5, 2016 agenda).
