Background:
Section 2.4.7(E), Appeals, of the Land Development Regulations applies. This is the method of informing the City Commission of the land use actions which may be appealed to the City Commission. After this meeting, the Commission’s appeal opportunity shall expire. An appeal by an aggrieved party must be made within 10 working days of the action. To appeal:
• The item must be raised by a Commission member.
• By motion, an affirmative action must be taken to place the item on the next available meeting of the Commission as an appealed item.
During the specified period, the Site Plan Review and Appearance Board considered the projects noted below. For each item, a project report including the Board Staff Report is attached. No other Boards took action on any appealable applications during this period.
SITE PLAN REVIEW AND APPEARANCE BOARD
ITEM A. Ligotti Medical Office, 406 SE 6th Avenue
Request: Class I Site Plan Modification for architectural elevation changes.
Board Action: Approved on a 4 to 2 vote with conditions (Jim Knight and James Chard dissenting, Andrew Youngross absent).
ITEM B. Dunkin Donuts at Linton Square, 1585 South Congress Avenue
Request: Class III Site Plan Modification, Landscape Plan and Architectural Elevation Plan for the construction of a new drive-thru restaurant outbuilding within the Linton Square Shopping Center.
Board Action: Approved the Site Plan on a 5 to 1 vote (James Chard dissenting and Andrew Youngross absent) with conditions. The Landscape Plan and Architectural Elevation Plan were approved on a 6 to 0 vote (Andrew Youngross absent). Conditions of approval were added by the Board for the architectural elevation plan.
ITEM C. Auto Zone Delray, 2200 North Federal Highway
Request: Class V Site Plan, Landscape Plan and Architectural Elevation Plan for the construction of a retail building and associated site improvements, and a Waiver to LDR Section 4.4.9(F)(2)(a) which requires a minimum building setback of 5’ and a maximum setback of 15’ in the North Federal Highway Area.The proposed building setback was 20’.
Board Action: Approved the Site Plan on a 6 to 0 vote (Andrew Youngross absent) with conditions.The Landscape Plan was approved on a 6 to 0 vote (Andrew Youngross absent) and the Architectural Elevation Plan on a 5 to 1 vote (Vlad Dumitrescu dissenting and Andrew Youngross absent). The requested waiver was denied on a 6 to 0 vote (Andrew Youngross absent).
ITEM D. Kelly Building, 1302 Wallace Drive
Request: Class V Site Plan, Landscape Plan and Architectural Elevation Plan for the construction of an office and strorage building and associated site improvements.
Board Action: Approved the Site Plan, Landscape Plan and Architectural Elevation Plan on a 6 to 0 vote (Andrew Youngross absent).
City Attorney Review:
Approved as to form and legal sufficiency.
Timing of Request:
Action must be taken by the City Commission at the next available meeting following the Board’s actions.
