LANDSCAPE MAINTENANCE AGREEMENT FOR 82 NW 5th AVENUE

Motion to Accept a Landscape Maintenance Agreement for proposed landscaping along NW 5th Avenue associated with the West Settlers Office Building located at 82 NW 5th Avenue. The landscaping will exist within the right-of-way and will continue to be an enhancement to the streetscape along NW 5th Avenue.

Background:
The Landscape Maintenance Agreement is associated with the construction of a two-story (1st floor 4,587 square foot and 2nd floor 3,123 square foot), mixed use building containing office space on the ground floor, and three (3) residential units on the second floor in the West Settlers Historic District. At its meeting, January 21, 2015, the Historic Preservation Board (HPB) approved the site plan, architectural elevations, and landscape plans. It has been determined that landscape plan exhibits proposed plantings along the right of way on NW 5th Avenue therefore requiring a landscape maintenance agreement. The attached agreement has been reviewed and approved by the City Attorney’s Office for legal form and sufficiency and is now before the City Commission for approval.
