Title
ACCEPTANCE OF SETTLEMENT AGREEMENT FOR CITY PROPERTY DAMAGE CLAIM
Body
Recommended Action:
Recommendation
Staff are requesting approval to settle a City property damage claim in the amount of $201,670.41.
Body
Background:
On February 27, 2026, equipment operated by Youngquist Brothers, a vendor hired by the City to work on the water treatment plant capital improvement project, failed during construction activities causing cement to be discharged onto several City vehicles, Building C, and the immediate surrounding area. The incident resulted in significant property damage and required cleanup and remediation efforts.
City staff has reviewed the proposed settlement and determined that the amount is reasonable and adequately resolves the City’s property damage claim arising from the February 27, 2026, incident. Approval of the settlement will allow the City to recover costs associated with the damages and conclude this matter without further dispute.
City Attorney Review:
Approved as to form and legal sufficiency.
Funding Source/Financial Impact:
The City will receive settlement proceeds in the amount of $201,670.41.
