Motion to Approve Amendment No. 1 to Interlocal Service Agreement between the City of Delray Beach and the Town of Highland Beach (“Agreement”), extending the deadline for the Town of Highland Beach to notify of its desire to exercise its contractual option to renew the Agreement.

Background:

The parties executed the Agreement on July 3, 2002 for the provision of comprehensive fire and emergency medical services by the City of Delray Beach within the municipal boundaries of the Town of Highland Beach.  The Agreement expires at midnight on September 30, 2017. 

 

The Agreement allows the parties to extend the term of the Agreement for periods of ten (10) years upon the mutual agreement of the parties; however, in order to exercise this option, the Town of Highland Beach must first notify the City of Delray Beach of its desire to renew the Agreement at least eighteen (18) months prior to expiration, which deadline date is March 30, 2016.

 

In order for the parties to continue to negotiate an extension of the Agreement for the mutual benefit of their residents, this Amendment No. 1 extends that notification deadline until May 30, 2016, with the option to further extend the deadline upon the mutual agreement of the Town Manager of the Town of Highland Beach and the City Manager of the City of Delray Beach.

 

The Amendment does not otherwise affect the terms of the Agreement.

 

Timing of Request:

Timing is of the essence for this matter to be addressed at the City Commission’s March 15, 2015 regular meeting, as the next City Commission regular meeting occurs after the Agreement’s notification deadline has passed.
