Motion to Approve a Tri-Party Agreement with the Florida Department of Transportation (FDOT) and the South Florida Regional Transportation Authority (SFTRA) for Surface Crossing Work at 10th Street along the South Florida Rail Corridor (SFRC).

Background:
On July 14, 2023, the Public Works Department was notified by FDOT that a comprehensive analysis of the SFRC mainline was performed to assess the current conditions of the Highway-Rail Grade Crossings throughout Palm Beach, Broward, and Dade counties. All crossings within the three (3) counties were subsequently evaluated and it was determined that the 10th Street Crossing needs to be reconstructed. 10th Street is a City of Delray Beach (City) owned roadway, therefore the City is responsible for costs related to the crossing, such as routine maintenance and rehabilitation projects. SFRTA manages railroad operations on the SFRC on behalf of FDOT and requires an executed agreement to begin design and procurement of materials for the crossing rehabilitation.

On October 1, 2024, the City approved the Tri-Party Agreement, then estimated cost to the City $733,613.00 for the surface crossing work to be performed by SFRTA.

In 2025, it was determined the agreement should be amended to add reconstruction of the railroad crossing and pedestrian sidewalk installation at the southern crossing point.
