Background:
The subject property is located on the southeast corner of Palm Court and George Bush Boulevard. The property is within the Del-Ida Park Historic District, and is zoned Residential Office (RO). At its meeting of October 19, 2016, the Historic Preservation Board (HPB) approved a Certificate of Appropriateness (COA) Class V Site Plan, Landscape Plan, Architectural Elevations and Waiver request for the new construction of a two-story mixed-use building containing office and residential uses. The approval was conditioned on the approval of a 5’ wide right-of-way dedication prior to the issuance of a building permit.
Pursuant to LDR Section 5.3.1(D)(2) and the Transportation Element of the City’s Comprehensive Plan, the required right-of-way width for George Bush Boulevard is 80’, whereas 50’ of right-of-way presently exists. At its meeting of October 1, 2015, the Development Services Management Group (DSMG) and City Engineer reviewed the right-of-way for George Bush Boulevard and determined that 60’ of right-of-way is sufficient. Therefore, only a 5’ wide dedication (half the distance of the difference) is required. The dedication for George Bush Boulevard is required via the plat process, or may be provided via separate instrument prior to the plat being reviewed and approved.
