Consideration of the following Item:

The Development Services Management Group (DSMG) is asked to make a recommendation to the City Engineer for the Right-of-Way Width Reduction request from the owners of 2 NW 18th Ave, which shall be referred to henceforth as the Drutau Retail Project.

Background:

On September 24, 2024, a plat was submitted for the subject property.  One of the items  required on the plat was a dedication of a 25’ Right-of-Way Radius at the intersection of West Atlantic Avenue and NW 18th Avenue.  The applicant duly showed the required dedication on the plat.  The property is subject to a blanket easement over the entirety of the property according to the applicant and that requires the approval of the blanket easement holder.  That has proven difficult and the owner is requesting the DSMG convert the Right-of-Way dedication to an Ingress/Egress Easement, which is allowed as an alternative provision made to accommodate features which would otherwise be accommodated within the right-of-way, per LDR Section 5.3.1(A)(7)(c).
