Motion to approve Amendment No. 3 to the Exclusive Franchise Solid Waste and Recycling Collection Agreement dated February 27, 2023 between the City of Delray Beach and Waste Management Inc. of Florida.

Background:
On February 27, 2023, the City of Delray Beach (the “City”) entered into an Exclusive Franchise Agreement with Waste Management Inc. of Florida (“Waste Management” and/or "Contractor") for a term that commenced as of October 1, 2023 (the "Agreement").
In the current Exhibit 1 Curb Side Plastic Bag Service of the Exclusive Franchise Agreement with Waste Management (page 118 of the attached franchise agreement), Imperial Villas, a residential community located in service Zone 5 is highlighted in yellow as part of the current plastic bag services in Imperial Villas, Country Manors, and Highpoint of Delray. In the proposed updated version of Exhibit 1 (Amendment 3), the highlighted area for Imperial Villas has been removed due to the change of service from plastic bag service to curbside roll cart beginning on October 1, 2026. Country Manors and Highpoint of Delray will remain highlighted in yellow as there is no change of service for these communities. The change for Imperial Villas was agreed to by the City and Contractor. This change in service will increase efficiency in solid waste collection and has no impact on the rate charged for solid waste services to the residents of Imperial Villas.
The title of Exhibit 1 will also be changed from Curb Side Plastic Bag Service to Residential Curbside Service because the map reflects the type of residential service and days of residential service the Contracto...
