Consideration of the following Item:

The Development Services Management Group (DSMG) is asked to make a recommendation to the City Engineer for the Right-of-Way Width Reduction request from the owners of 802 SE 5th Ave, which shall be referred to henceforth as the Delray Dermatology Project.

Background:

On September 6, 2024, a development application was submitted for the subject property.  One of the items  required was a dedication of 5’ of Right-of-Way along SE 8th Street and a 20’ x 20’ Right-of-Way Corner Clip at the intersection of SE 8th Street and SE 5th Avenue.  The applicant duly showed the required dedications on their plans and their plat application.  That dedication has proved to be an issue with the owner of the project, therefore the owner is requesting the DSMG convert the Right-of-Way dedications to Ingress/Egress Easements, which is allowed as an alternative provision made to accommodate features which would otherwise be accommodated within the right-of-way, per LDR Section 5.3.1(A)(7)(c).
