Title

ITEM A1 - ACCEPTANCE OF A GENERAL UTILITY EASEMENT FOR PROPERTY LOCATED AT 510 W LINTON BOULEVARD.

Body

Recommended Action:

Recommendation

Consideration of the following item:

ITEM A1 - Motion to approve and accept a Water and Sewer Utility Easement Agreement. Property Control Number 12-43-46-29-51-001-000.

Body

Background:

Item A1 - The owner (s) of record, CCB Associates 21, LLC., discovered the previous owner of noted property had not effected a Water and Sewer Utility Easement Agreement when a portion of the sanitary sewer system and water main system was relocated on the property during a previous building addition on the subject property. The easement is required to allow access for inspection and maintenance of the City's utilities.

There is no cost to the City now or in the future for this item.

City Attorney Review:

Approved to form and legal sufficiency.

Funding Source/Financial Impact:

N/A

Timing of Request:

The timing of this request is of high importance to allow the owner (s) of the property to get the utility easement abandoned over the previous location of the water and sewer systems subject to the relocation. The utility easement abandonment is not part of this action.
