Motion to Ratify an emergency action awarding Foster Marine Contractors, Inc. in the amount of $14,972 for the repair of a sanitary sewer main at 1595 SW 4th Avenue. The recommendation complies with the Code of Ordinances, Chapter 36, Section 36.02(C)(5), “Emergency Acquisitions”.

Background:
In mid-March, 2016, Florida Power and Light was performing work replacing wood poles with concrete poles along the east side of SW 4th Avenue, just north of Linton Boulevard. Although utility locations were requested by the contractor, and appropriately marked, during the work effort, the placement of one of the poles compromised the sewer main, as it was placed too close in proximity of the sewer main. Staff has coordinated with the City’s Risk Management Department and is seeking reimbursement for the repair from Florida Power and Light.

Staff contacted three utility contractors to solicit pricing for the repairs; Foster Marine Contractors, Inc., DP Development of the Treasure Coast LLC (DP Development), and Mancon, Inc. All three vendors responded appropriately to assess the situation and submitted pricing as follows; Foster Marine Contractors, Inc. in the amount of $14,972.00, Mancon, Inc. at $16,000.00, and DP Development at $63,792.00.

Under the circumstances, staff recommended that this work be considered an emergency situation, to be performed as soon as possible, and sought authorization from the City Manager to proceed with the work per Code of Ordinance 36.02 (C) (5), Emergency Acquisitions.
