Motion to Approve the retention of Terrill Pyburn, Esq. as special counsel to amend  the procedure to request accommodations to the City’s Land Development Regulations.

Background:

On July 5, 2016, the Commission directed the Interim City Attorney to retain special counsel for discrete projects that require specialized legal expertise until a permanent replacement for the City Attorney has been hired. The Interim City Attorney proposes that the City obtain Terrill Pyburn, Esq. for the following scope of work:

 

The Planning department has requested the City Attorney’s assistance in adding additional requirements to the City’s process for requesting accommodations to the City’s Land Development Regulations (LDRs).  In response to Planning’s request, Ms. Pyburn will perform the following tasks: (1) research and draft appropriate amendments to the Land Development Regulations pertaining to reasonable accommodations, (ii) update the Request for Accommodation application form to reflect these amendments, and (iii) draft and prepare guidelines for staff review of Request for Accommodation applications.

 

Ms. Pyburn has extensive knowledge of the Americans with Disabilities Amendments Act (ADA) and the Fair Housing Amendments Act (FHA) as well as  experience drafting, applying and defending the relevant sections of the City’s LDRs. Ms. Pyburn proposes to charge a rate of $200/hour, with the total fees for the scope of services described above not to exceed $15,000.
