Background:
This item provides a correction to the Major Subdivision Plat originally approved as "Magnolia Place" to rename the plat as "Magnolia Place Delray".
On March 5, 2024, the City Commission approved Resolution No. 19-24 (attached), which approved a major subdivision plat of multiple properties located north of SE 2nd Street on the west side of SE 1st Avenue within the Old School Square Historic District. The plat implemented the approvals for the redevelopment of the properties as five two-story duplex structures (10 units) on five new lots. Resolution No. 19-24 approved the subdivision, with two waivers to lot width and minimum lot frontage. The resolution also established the sequence of the demolition of the existing structures and the execution of the plat.
Following the removal of the existing structures, the plat was fully executed and sent to the Palm Beach County Clerk of Courts for recording. At that time, the clerk in the Court Operations/Recording Department identified a plat for "Magnolia Place" recorded in Riviera Beach in 2017 and was not able to record a plat with the same name in Delray Beach. The applicant has changed the name to "Magnolia Place Delray." The Clerk of the Circuit Court & Comptroller of Palm Beach County has confirmed the name, "Magnolia Place Delray" is available through the attached Certificate of No Plat. No other changes are proposed the approved plat.
